The case plan, when applicable, should include: a. An estimated budget of fhe legal fees and expenses fhat could potentially be incurred; b. A preliminary assessment of FAFAA's exposure and possible liability; c. A plan for fhe discovery process; d. Potential defenses for FAFAA, and the practicability and potential for early disposition of the case by reaching a favorable settlement wifh fhe ofher party. Outside Counsel should seek a dispositive resolution or early settlement, where possible, if such course of action is in fhe best interests of FAFAA; e. Written insh'uctions regarding who should be covered by any applicable litigation hold, and fhe type of data fhat should be preserved by fhe different areas of fhe FAFAA, Outside Counsel should be responsible for ensuring fhat litigation holds are diligently placed on potentially relevant documents and fhose potentially relevant employees are notified of fhese holds as soon as possible. Furthermore, Outside Counsel should make sure fhat fhe holds are periodically reiterated so fhat all potentially relevant employees are aware of and remember the holds, and all potentially relevant documents are included in fhe holds. ii. FAFAA may refer to Outside Counsel a particular matter which may require extended work or research or may seek fhe advice or assistance of Outside Counsel in special projects. In any such case, Outside Counsel shall prepare and provide FAFAA with an estimated budget of the legal fees and expenses that could potentially be incurred FAFAA for fhe handling of such matter. The form of the Monthly Status Report shall be previously agreed upon by Consultant and FAFAA.

  • Business Plan and Budget As soon as available, but in any event within sixty (60) days after the end of each fiscal year of the Borrower, an annual business plan and budget of the Borrower and its Subsidiaries on a Consolidated basis, including forecasts prepared by management of the Borrower, in form reasonably satisfactory to the Lender, of Consolidated balance sheets and statements of income or operations and cash flows of the Borrower and its Subsidiaries on a fiscal year basis and, in the case of such forecasted statements of income, on a fiscal quarterly basis for the immediately following fiscal year. As to any information contained in materials furnished pursuant to Section 6.02(f), the Borrower shall not be separately required to furnish such information under Section 6.01(a) or (b) above, but the foregoing shall not be in derogation of the obligation of the Borrower to furnish the information and materials described in Sections 6.01(a) and (b) above at the times specified therein.
