Reliability Standards Sample Clauses
The Reliability Standards clause sets out the minimum performance and operational criteria that a party must meet to ensure consistent and dependable service or product delivery. Typically, this clause references specific industry standards or regulatory requirements that must be adhered to, and may require regular testing, reporting, or certification to demonstrate compliance. Its core function is to ensure that all parties maintain a high level of reliability, thereby reducing the risk of service interruptions or failures and providing assurance to stakeholders.
Reliability Standards. (a) In connection with its Delegated Authority, SPP shall be entitled to:
(i) propose Reliability Standards, Regional Variances, or modifications thereof to NERC, which shall be considered by NERC through an open and inclusive process for proposing and adopting Reliability Standards that affords SPP reasonable notice and opportunity to be heard; and
(ii) develop Regional Reliability Standards [and Regional Variances, if Regional Entity is organized on an Interconnection-wide basis] through SPP’s process as set forth in Exhibit C. Proposals approved through SPP’s process shall be reviewed by the NERC Board of Trustees after NERC provides notice and an opportunity for interested persons to comment. In the case of a proposal from a Regional Entity organized on an Interconnection- wide basis, comments shall be limited to the factors identified in NERC Rule 313, section 3.1 as it may be amended from time to time. The NERC board of trustees shall promptly thereafter consider such proposed Regional Reliability Standard or Regional Variance, applying the rebuttable presumption described in subsection 5(b) if the proposed Regional Reliability Standard or Regional Variance is from a Regional Entity organized on an Interconnection-wide basis, and either approve the proposed standard and submit it to the Commission for approval, or disapprove it in writing setting forth its reasons. SPP may appeal any disapproval of a proposed Regional Reliability Standard or Regional Variance to the Commission.
(b) Pursuant to Section 215(d)(3) of the Act, NERC shall rebuttably presume that a proposal from a Regional Entity organized on an Interconnection-wide basis for a Regional Reliability Standard or Regional Variance or modification thereof to be applicable on an Interconnection-wide basis is just, reasonable, and not unduly discriminatory or preferential, and in the public interest. Any person challenging such proposal from the INTERCONNECTION-WIDE REGIONAL ENTITY shall have the burden of proof. NERC shall not find that this presumption has been rebutted except based upon substantial evidence that has been disclosed to, and been subject to comment by, the INTERCONNECTION-WIDE REGIONAL ENTITY during NERC’s review of the proposal.
Reliability Standards. The Corporation shall:
(1) propose Reliability Standards, Regional Variances or modifications thereof to NERC; and
(2) develop Regional Reliability Standards through the Corporation’s standards development procedure.
Reliability Standards. It shall be the duty of the Management Committee, after review of reports or actions of the System Operator and the Market Reliability Planning Committee and Regional Transmission Planning Committees and such other matters as the Management Committee deems pertinent, to establish or approve proper standards of reliability for the bulk power supply of NEPOOL. Such standards shall be consistent with the directives of the North American Electric Reliability Council and the Northeast Power Coordinating Council and shall be reviewed periodically by the Management Committee and revised as the Management Committee deems appropriate.
Reliability Standards. Without limiting the generality of Section 5.1, the Service Provider shall comply with all Alberta Reliability Standards and all ISO Rules, as amended, supplemented, replaced or otherwise modified from time to time.
Reliability Standards. Seller shall operate the Facility in a manner that complies with all national and regional reliability standards, including standards set by NERC, FERC, MRO and the URC, or any successor agencies setting reliability standards for the operation of generation facilities. To the extent that Seller or the Facility contributes in whole or in part to actions that result in monetary penalties being assessed to Company by NERC, the MRO, or any successor agency, for lack of compliance with reliability standards, Seller shall reimburse Company for its share of such monetary penalties.
Reliability Standards. It shall be the duty of the Participants Committee, after review of reports, recommendations and actions of the System Operator and the Reliability Committee and such other matters as the Participants Committee deems pertinent, to establish or approve Reliability Standards for the bulk power supply of NEPOOL. Such Reliability Standards shall be consistent with the directives of NERC and the NPCC and shall be reviewed periodically by the Participants Committee and revised as the Participants Committee deems appropriate.
Reliability Standards. 21.1.1 Each Party will maintain responsibility to comply, at its own expense, with NERC and Regional Entity mandatory Reliability Requirements applicable to the facilities owned by the Party. The Parties agree to share data or documentation as may be required to demonstrate compliance with Reliability Requirements where an individual Party has possession of data or documentation necessary for the other Party to demonstrate compliance.
21.1.2 To the extent that MHVDC Connection Customer contributes in whole or in part to actions which result in monetary penalties being assessed to Transmission Owner for non- compliance with Reliability Requirements, MHVDC Connection Customer shall reimburse Transmission Owner for its proportional share of such monetary penalties. To the extent that Transmission Owner contributes in whole or in part to actions which result in monetary penalties being assessed to MHVDC Connection Customer for non- compliance with Reliability Requirements, Transmission Owner shall reimburse MHVDC Connection Customer for its proportional share of such monetary penalties. NERC, or the Regional Entity by which a compliance penalty has been assessed, will make the determination of the responsible parties and the contribution to such non-compliance event(s). In the event of a dispute between the Parties regarding either Party’s share of such monetary penalties, the dispute shall be subject to the provisions of Article 18 herein.
Reliability Standards. Seller shall operate the Exchange Resource in a manner that complies with the reliability standards that apply to geothermal electric generation facilities, including standards set by the Transmission Operator, NERC, WECC, and FERC, or any successor agencies setting reliability standards for the operation of such generation facilities. To the extent that Seller does not operate the Exchange Resource in accordance with such standards and Seller’s performance results in monetary penalties being assessed against Seller, the Exchange Resource or Purchaser by the Transmission Operator, NERC, WECC, or FERC, as between Purchaser and Seller, Seller shall be solely responsible for paying any such monetary penalties.
Reliability Standards. Seller shall operate the BPA Wind Turbines in a manner that complies with the operating requirements set forth in the Interconnection Facilities Agreement.
Reliability Standards. The Parties agree to adhere to the reliability standards promulgated by NERC as the FERC-approved ERO and the RE, provided that any such reliability standard has been approved by FERC. The Parties shall use commercially reasonable efforts to comply with reliability standards, or modifications thereto, that are adopted by NERC or the RE, but not yet approved by FERC.
