Representative of the Owner Sample Clauses

Representative of the Owner. The Architect will be a representative of the Owner during construction and in this capacity will endeavor to: (a) guard the Owner against variances from the requirements of the Contract Documents by the Contractor, (b) require the Contractor to complete the Work within the time specified in the Construction Contract or subsequently extended by the Owner, (c) and guard the Owner against Defective Work. The Architect will advise and consult with the Owner regarding the performance and progress of the Contractor and regarding solutions to conditions or problems that may arise out of the design or construction. The Architect shall have authority to act on behalf of the Owner to the extent provided in the General Conditions of the Contract, which may only be modified in writing.

(d) While it is incumbent upon the Architect to issue the Owner’s instructions to the Contractor, this paragraph is not intended to imply any prohibition against the Owner issuing instructions directly to the Contractor when necessary, but in such cases the Owner’s representative will advise the Architect of such instructions having been issued. In such cases the Owner’s Representative shall endeavor to notify the Architect prior to issuance of instructions to the Contractor and if prior notice is not made to the Architect then it shall be furnished as soon as possible after the issuance of such instruction. If the Architect has a reasonable objection to the any such direction or instruction he shall advise the Owner’s Representative of the objection, in writing, in a timely manner. The Architect will provide at the start of the project and maintain throughout construction a “flowchart” to confirm the agreed upon communication/routing of information and any needed clarifications of responsibilities.
