Request for Capacity. On each occasion that additional wastewater treatment capacity is to be requested, ▇▇▇▇▇ shall submit a written Capacity Request Notice to the CDD specifying the capacity being requested and the proposed date of delivery of such capacity. Within 30 days of receipt of the Capacity Request Notice the CDD shall notify ▇▇▇▇▇ in writing whether such capacity is then available.
Request for Capacity. A request for Annual Band capacity with a long notice period must necessarily include the following information:  A level of capacity that is strictly positive, subject to the following condition: for the Shipper and for a given PIR, the cumulative capacity requests must be equal to or less than the capacity ceiling announced by GRTgaz before the commercialisation period.  A duration, expressed in whole years, greater than or equal to two (2) years and less than or equal to fifteen (15) years,  An allocation profile, which can be either “Band” or “Maximisation”. The capacity allocated in response to a request will be the same for each year if the Shipper chose the “Band” option, or may be different if the “Maximisation” option was chosen.
Request for Capacity. WMU and ECCWD hereby acknowledge and agree that the quantity of water allocated in Paragraph 6 of this Agreement was available capacity ofthe WMU water system. Both parties agree that if in the future should ECCWD require an additional quantity of water to serve growth, that such a request will be made in wriing to WMU and that WMU will consider the request through the normal business routine as WMU would consider for approval a request for capacity from any developer. Increases in the quantity of water to be supplied to ECCWD, upon approval by in the normal of business, will be noted in the meeting minutes of the WMU Commission and be appended to this Agreement.

  • Independent Capacity of Contractor The Contractor and Contractor Parties shall act in an independent capacity and not as officers or employees of the state of Connecticut or of the Agency.

  • Trustee Capacity It is expressly understood and agreed by the parties hereto that (i) this Assignment Agreement is executed and delivered by U.S. Bank National Association, not individually or personally but solely on behalf of GSAA Home Equity Trust 2006-3, as the Assignee, in the exercise of the powers and authority conferred and vested in it, (ii) each of the representations, undertakings and agreements by U.S. Bank National Association is made and intended for the purpose of binding only the GSAA Home Equity Trust 2006-3, (iii) nothing herein contained shall be construed as creating any liability for U.S. Bank National Association, individually or personally, to perform any covenant (either express or implied) contained herein, and all such liability, if any, is hereby expressly waived by the parties hereto, and such waiver shall bind any third party making a claim by or through one of the parties hereto, and (iv) under no circumstances shall U.S. Bank National Association be personally liable for the payment of any indebtedness or expenses of the GSAA Home Equity Trust 2006-3, or be liable for the breach or failure of any obligation, representation, warranty or covenant made or undertaken by the GSAA Home Equity Trust 2006-3 under this Assignment Agreement, the Trust Agreement or any related document.

  • Corporate Capacity The Acquirer has the corporate power, capacity and authority to enter into and complete this Agreement;
