Requested Restrictions Clause Samples
The Requested Restrictions clause defines specific limitations or conditions that one party asks the other to observe during the course of their agreement. This may include restrictions on the use, disclosure, or handling of certain information, or limitations on activities such as marketing, sublicensing, or data sharing. By clearly outlining these requested boundaries, the clause helps prevent misunderstandings and ensures that both parties are aware of and agree to the particular constraints, thereby reducing the risk of disputes and promoting compliance with agreed-upon terms.
Requested Restrictions. Covered Entity shall notify Business Associate, in writing, of any restriction on the use or disclosure of PHI that Covered Entity has agreed to in accordance with 45 C.F.R. § 164.522, which permits an Individual to request certain restrictions of uses and disclosures, to the extent that such restriction may affect Business Associate’s use or disclosure of PHI.
Requested Restrictions. Business Associate acknowledges that Covered Entity is required under § 13405(a) of HITECH to comply with an individual’s requested restriction regarding his or her PHI if (unless the disclosure is otherwise required by law):
a) the disclosure is to a health plan only for purposes of carrying out payment or health care operations (but not treatment), and
b) Covered Entity’s PHI pertains solely to a health care item or service for which Covered Entity has been paid out-of-pocket in full by the individual or the individual’s representative. Business Associate shall comply with any such requested restriction that applies to Business Associate’s further use or disclosure of Covered Entity’s PHI and of which Business Associate is made aware.
Requested Restrictions. Business Associate will notify Covered Entity of requests for restrictions that Business Associate receives under 45 C.F.R. § 164.522 or similar Rules from individuals who are customers or employees of Covered Entity.
Requested Restrictions. To the extent instructed by Covered Entity in writing, Business Associate shall comply with a request by an Individual to restrict Disclosure of the Individual’s PHI to a health plan in accordance with 45 C.F.R. 164.522. Business Associate shall promptly direct to Covered Entity all such requests Business Associate receives directly from an Individual.

Customer will not provide to [Business Associate] any PHI that is subject to any arrangement permitted or required of Customer that may impact in any manner the use or disclosure of PHI by [Business Associate] under this Addendum including, but not limited to, any restriction on the use or disclosure of PHI as provided in 45 C.F.R. § 164.522 and agreed to by Customer.
Requested Restrictions. Covered Entity will not provide to Medstat any PHI that is subject to any arrangement per- mitted or required of Covered Entity that may impact in any manner the use or disclosure of PHI by Medstat under this Addendum including, but not limited to, any restriction on the use or disclosure of PHI as provided in 45 C.F.R. § 164.522 and agreed to by Covered Entity.
