Requests for Reclassification Clause Samples
The "Requests for Reclassification" clause establishes the process by which a party may formally ask for a change in the classification or categorization of certain items, information, or personnel under the agreement. Typically, this involves submitting a written request outlining the reasons for reclassification and may require supporting documentation or justification. This clause ensures that there is a clear and standardized method for addressing concerns about misclassification, thereby promoting fairness and accuracy in the administration of the contract.
Requests for Reclassification. Requests to have a position analyzed for possible reclassification into an existing bargaining unit position may be made by a unit member. A request by a unit member to have a position analyzed shall be made on a Reclassification Request Form and submitted to the unit member’s immediate supervisor by January 31 for their comments prior to routing the request to Human Resources for review and consideration by the Reclassification Committee. No employee working in the same classification may submit a request for reclassification more than once in any two-year period.
Requests for Reclassification. A unit member who has completed his/her probationary period may request reclassification of his/her position by submitting a "Request for Classification Review" (Appendix H) form to the Human Resources Department between November 1st and December 15th, for consideration during the current fiscal year. Reclassifications approved by the Board will become effective July 1st of the following fiscal year.
Requests for Reclassification. 36.8.1 Review Process for Requests
(1) year has elapsed since the last review. Denial of a review by the Director of Human Resources may be grieved under the provisions of Article 6.3.
Requests for Reclassification a. A request for reclassification may be submitted by an employee, the immediate supervisor, or the Association, utilizing the District process for dealing with reclassification requests.
b. The District will consider requests once each year, unless there is mutual agreement for special consideration. All requests must be received by February 1st of any year and will be acted upon during that month.
Requests for Reclassification. The County may consider a request for reclassification at any time. A request must be made in writing by the department head to the Director, Human Resources & Risk Management. If, in the opinion of the County Administrative Officer, the position justifies reclassification, he may recommend an appropriate new classification and/or salary range to the Board of Supervisors.
Requests for Reclassification. When (1) a permanent employee, (2) the Food Services Director, or (3) the union, feels that an employee is incorrectly classified, a request for a classification review may be submitted to the employer. The review will be carried out, the above parties notified, and any adjustment will be retroactive to the first of the month closest to the date the request for review was received by the employer. Notwithstanding the above, no incumbent will have a reduction in salary rate as a result of this process.
Requests for Reclassification. The following procedures shall be the sole means of settling disputes concerning the maintenance of the classification system, including, but not limited to, disputes regarding the classification of individual positions and the salary ranges assigned to specific job classifications.
a. In the event there has been a material change in job duties assigned or in duties included in the published job description for a given position, a request for individual position evaluations and reclassifications shall be submitted to the Human Resources Director by the immediate supervisor of the person making the request. Either JESS or the District may initiate such a review.
b. Requests for a group job class evaluation and reclassification shall be submitted to the Human Resources Director by JESS, subject to the same requirements listed above.
c. The Human Resources Director will audit the duties and responsibilities of the job class and their relationship to the job description of the position in which the employee(s) is/are operating.
d. The Human Resources Director will render a decision within thirty (30) days of receipt of the request for position evaluation or job class evaluation. In the event a decision is rendered after thirty (30) days, which approves the reclassification request, the reclassification shall be made effective thirty (30) days after the request was submitted.
e. JESS may submit to the District a notification of appeal within fifteen (15) days of receipt of the Human Resources Director’s decision.
f. JESS and the District will agree to a neutral third-party to hear the appeal and to recommend action for resolution to the dispute. Costs incurred by the neutral third-party shall be shared equally between the District and JESS.
g. The recommendation will be submitted to the Superintendent for a binding decision. If a change in classification is warranted, upgrading will occur at the time of the decision and not be retroactive, except as noted in “d”, above.
Requests for Reclassification. The City will notify the Union within 30 days of its intent to reclassify any position based upon duties and responsibilities. Employees who are performing additional duties for a temporary period are not covered by this section, but are covered by Article 6
Requests for Reclassification. 1. Requests to have a position analyzed for possible reclassification may be made by permanent bargaining unit members who have served in their position for at least one year. A request by a unit member to have a position analyzed shall be made on a Reclassification Request Form and submitted to the unit member’s supervisor by January 31. The supervisor will then review the request, provide comments and submit the request to the Human Resources Department within five (5) days of receipt.
2. Human Resources will provide the unit member with a signed copy of the Review Verification form no later than fifteen (15) days after the January 31st deadline.
3. The Human Resources Department will forward the Reclassification Form to the Reclassification Committee no later than February 15th.
4. The Reclassification Committee will complete the review process no later than March 15th.
5. The following procedures shall govern the Reclassification Committee:
a. The committee must determine by a minimum 4-2 vote the recommendation or denial of each request for reclassification.
b. The recommendation of the committee shall be forwarded to the Superintendent or designee for approval.
c. If applicable, the Superintendent or designee shall submit their recommendation to the Board of Trustees at the next regularly scheduled meeting.
