RESPONSIBILITIES OF SUBRECIPIENT. The Subrecipient agrees to: A. Abide by the IDEA 20 U.S.C. § 1400, et seq.; 34 CFR Part 303; Wyo. Stats. § 21- 2-701 through 706; Wyoming Department of Health Administrative Rules, Chapter 8: Services for Infants and Toddlers with Developmental Delays; and any subsequent revisions to these federal and state rules, which are incorporated into this Contract by this reference. B. Provide the services described in Attachment A. C. Abide by guidance set forth in Attachment B, Fiscal Assurances, which is attached to and incorporated into this Contract by this reference. D. Ensure Subrecipient’s staff are available to provide continuous services under this Contract on a general business schedule, including summer months. Notice of upcoming closures and planned closures must be indicated on a calendar for the public to access. E. Utilize age appropriate assessment instruments for evaluating children ages birth through two (2) years to determine the need for early intervention services. F. Adhere to Wyoming Early Hearing Detection and Intervention (EHDI) hearing screening protocols and procedures, which are incorporated into this Contract by this reference, and complete timely submission of screening results and follow-up information for both hearing and vision in the Wyoming EHDI tracking system. G. Ensure all services are provided by qualified professionals in accordance with Wyoming licensure requirements for related service providers, and the Wyoming Department of Family Services Child Care Licensing rules, which are incorporated into this Contract by this reference. H. Adhere to all complaint procedures as required in 34 CFR Part 303 Early Intervention Program for Infants and Toddlers with Disabilities and Wyoming Department of Health Administrative Rules, Chapter 8 Services for Infants and Toddlers with Developmental Delays. I. Keep all computer software and applications up-to-date. J. Create, receive, maintain, or transmit individually identifiable education records in a manner that would not violate any provision of the Family Educational Rights and Privacy Act (FERPA), IDEA, or other applicable federal, state, or local law. K. Establish, use, and maintain administrative, physical, and technical safeguards to protect the confidentiality, integrity, and availability of all individually identifiable education records that the Subrecipient creates, receives, maintains, or transmits and to prevent any use or disclosure of individually identifiable education records as provided by this Contract. L. Secure all personally identifiable information in its possession in accordance with the most current standards established by the National Institute of Standards and Technology (NIST), which are incorporated into the Contract by this reference. M. Notify the Agency within five (5) business days of any use or disclosure of individually identifiable education records not provided for by this Contract, any security incident, or any breach of unsecured individually identifiable education records of which the Subrecipient becomes aware. (i) Such notice shall include the identification of each individual whose individually identifiable education record has been, or is reasonably believed to have been subject to such use, disclosure, incident, or breach, a statement indicating whether the individually identifiable education record was secured or unsecured, and a description of any security measures used. (ii) A disclosure, incident, or breach shall be treated as discovered by the Subrecipient as of the first day on which such breach is known to the Subrecipient, or, by exercising reasonable diligence, would have been known to the Subrecipient. The Subrecipient shall be deemed to have knowledge of a disclosure, incident, or breach if the same is known, or, by exercising reasonable diligence, would have been known to any person (other than the person committing the disclosure, incident, or breach) who is an employee, officer, or other agent of the Subrecipient. (iii) All reports of breach involving unsecured individually identifiable education records by the Subrecipient shall also include the most current contact information available for each individual whose individually identifiable education record has been, or is reasonably believed to have been accessed, acquired, or disclosed, and any other information required by the Subrecipient for the notification of individuals.

Provide Be accessible to eligible children ages three (3) through kindergarten or until enrollment in another Local Education Agency (LEA) with disabilities throughout the services described in Attachment A.entire Contract period; have the capacity to provide a minimum of four hundred fifty (450) hours of preschool within the one hundred seventy-five (175) contact days as designated on the Individualized Education Program (IEP).
