Review by the Department Clause Samples

The "Review by the Department" clause establishes the department's authority to examine and assess certain documents, actions, or decisions related to the agreement. Typically, this clause outlines the process by which the department will conduct its review, including timelines, required submissions, and possible outcomes or feedback. For example, it may require a contractor to submit reports or deliverables for departmental approval before proceeding to the next project phase. The core function of this clause is to ensure oversight and quality control, allowing the department to verify compliance and address issues proactively.
Review by the Department. The parties hereto acknowledge and agree as follows: (a) Upon execution of this Agreement by both the Developer and the Owner, pursuant to the CDA the Developer will submit this Agreement, together with the attached Plans, to the Department for its review and approval as part of a package referred to as a “Utility Assembly”. The parties agree to cooperate in good faith to modify this Agreement and/or the Plans, as necessary and mutually acceptable to both parties, to respond to any comments made by the Department thereon. Without limiting the generality of the foregoing, (i) the Owner agrees to respond (with comment and/or acceptance) to any modified Plans and/or Agreement prepared by the Developer in response to Department comments within fourteen (14) business days after receipt of such modifications; and (ii) if the Owner originally prepared the Plans, the Owner agrees to modify the Plans in response to Department comments and to submit such modified Plans to the Developer for its comment and/or approval (and re-submittal to the Department for its comment and/or approval) within fourteen (14) business days after receipt of the Department’s comments. The Owner’s failure to timely respond to any modified Plans submitted by the Developer pursuant to this paragraph shall be deemed the Owner’s approval of same. If the Owner fails to timely prepare modified Plans which are its responsibility hereunder, then the Developer shall have the right to modify the Plans for the Owner’s approval as if the Developer had originally prepared the Plans. The process set forth in this paragraph will be repeated until the Owner, the Developer, and the Department have all approved this Agreement and accepted the Plans. (b) The parties hereto acknowledge and agree that the Department’s review, comments, and/or approval of a Utility Assembly or any component thereof is solely for the purpose of ascertaining matters of particular concern to the Department, and the Department has, and by its review, comments and/or approval of such Utility Assembly or any component thereof undertakes, no duty to review the Utility Assembly or its components for their quality or for the adequacy of Adjusted facilities (as designed) for the purposes for which they are intended to be used or for compliance with law or applicable standards (other than Department requirements).
Review by the Department. A. All faculty members shall provide their students the opportunity to evaluate their teaching in all their sections. These evaluations shall include the student feedback form (see Appendix L) with additional questions, if any, deemed relevant by the individual faculty and/or their department. The evaluations shall be submitted to their department, maintained by the department for their departmental review, and made available to the ▇▇▇▇ upon request.

Review by the Department. A. All faculty members shall provide their students the opportunity to evaluate their teaching in every course at least once per academic year. Annual and probationary faculty members shall provide their students the opportunity to evaluate their teaching in every class during every semester. These evaluations shall include the student feedback form (see Appendix L) with additional questions, if any, deemed relevant by the individual faculty and/or their department. The evaluations shall be submitted to their department and maintained by the department for their departmental review. B. Annual and Probationary Faculty Members 1. Annual and probationary faculty members shall be reviewed twice each year, except for the first year when they will be reviewed at least once, by their department on the basis of criteria given in Appendix K. The criteria will be provided to the faculty member by the Human Resources Department at the time of the faculty member’s employment. Reviews will be completed by February 15 each year for Fall appointments, October 15 for Winter appointments. 2. It is the responsibility of the annual or probationary faculty member to remind the department of its responsibility to perform the reviews in a timely manner, since eligibility for contract renewal may be jeopardized. C. Continuing Contract Faculty Members Continuing contract faculty members shall be reviewed at least once every three years by their department on the basis of the criteria given in Appendix K. Reviews will be completed by April 15th of that year.
Review by the Department. Greyhound shall provide copies of any then-current training materials to the Department upon 72 hours notice or whenever a substantial revision to its existing employee ADA training materials has been developed. Greyhound shall provide the Department with copies of its next revised employee ADA training materials after the Advisory Committee has reviewed the program and prior to its finalization and implementation. The Department shall be provided one week to review and to provide comments on this new program.

Related to Review by the Department

  • Review by the World Bank of Procurement Decisions The Procurement Plan shall set forth those contracts which shall be subject to the World Bank’s Prior Review. All other contracts shall be subject to Post Review by the World Bank.

  • Action by the Superintendent The Superintendent shall determine which of the alternative courses of action is proper and shall take appropriate action to implement such determination.

  • Review by the Bank of Procurement Decisions The Procurement Plan shall set forth those contracts which shall be subject to the Bank’s Prior Review. All other contracts shall be subject to Post Review by the Bank.

  • Review by the Association of Procurement Decisions The Procurement Plan shall set forth those contracts which shall be subject to the Association’s Prior Review. All other contracts shall be subject to Post Review by the Association.

  • Department Review The parties shall resolve disputes through written submission of their dispute to the Department’s Contract Manager. The Department shall respond to the dispute in writing within ten (10) Business Days from the date that the Department’s Contract Manager receives the dispute. The Department’s decision shall be final unless a party provides the other party with written notice of the party’s disagreement with the decision within ten (10) Business Days from the date of the Department’s decision. If a party disagrees with the Department’s decision, the party may proceed to subsection (b) below.
