The Right of Discovery clause grants parties the ability to obtain information, documents, or evidence relevant to a dispute or legal proceeding. RIGHT OF DISCOVERY. You undertake to allow Us to exercise the right of discovery, and particularly You shall provide Us with any documents and/or certified copies relating to your Sales Contracts and shall allow Us to make any check, including verifying whether You have fulfilled your obligations and made your declarations in a complete, exact and truthful manner.
RIGHT OF DISCOVERY. In any hearing, the Board of Review shall have the power to examine witnesses under oath and compel attendance or the production of evidence by subpoenas issued in the name of the Authority and attested by the Secretary to cause the Sheriff of the County of Marin to serve a subpoena issued by the Board and the refusal of a person to attend or to testify in answer to such subpoena shall subject such person to prosecution in the same manner set forth by law.

You shall provide us with any documents and/or certified copies relating to the sales contracts or the Factoring Agreements entered into with your customers and shall allow us to exercise a right of discovery or ensure that we can exercise a right of discovery with your customer in order to allow us to make any check, including verifying whether you or your customers have fulfilled the obligations and made all required declarations in a complete, exact and truthful manner.
