Common use of Right of Return within the Organization Clause in Contracts

Right of Return within the Organization. If the employee has attained permanent status in another Association position either pursuant to this provision or by virtue of having held the previous position for at least one (1) year, they shall have the right to return to a similar vacant position, for which they are qualified, if available, which is a part of the Association unit. The employee may also exercise whatever rights she/he may have under state law to claim any position in the District that is outside the Association unit.
