Right of Way Plans. Prepare design sheets with the appropriate land needs. This includes, but is not limited to, temporary and permanent construction easements, as well as accurate property lines. Right of Way Plans. VHB will develop draft Right of Way plans based on the Preliminary Plans accepted by the Owner. Using the project construction limits and any anticipated need for temporary rights during construction, VHB will determine the need for additional rights of way (ROW), including permanent and temporary easements, beyond the existing ROW to construct the project. Existing ROW, and all areas of additional ROW, whether temporary or permanent, will be clearly indicated on ROW plans prepared by VHB in accordance with standard survey practices. The plans will be submitted to the Owner for review and preparation of the draft deeds. Once the deeds are completed by the Owner, the draft ROW plans and deeds will be updated as needed for Owner approval prior to negotiating with property owners. ROW plans will include all of the Preliminary Plan elements with the addition of the following: • Right-of-Way detail sheet • Property Acquisition Table We assume the Owner will be responsible for all appraisals, property owner negotiations, and final acquisitions needed to complete the project. However, if the Owner prefers, VHB would be happy to provide ROW phase support as an additional service. Once the Owner has successfully acquired all property rights needed for the project, VHB will update the ROW plans to reflect any changes resulting from negotiations with property owners. A set of final ROW plans will be plotted and delivered to the Owner for recording in the City property records.

Right of Way Plans. Phase 2
1. The CONSULTANT will provide title insurance information for parcels where new right of way is being acquired, prepare right of way appraisals, and secure the necessary right of way by negotiation or condemnation, if necessary, for construction of this project. Any ownership deeds, easements deeds, subdivision plats, etc. needed or used in the development of existing property lines for the right of way plans will be furnished by the CONSULTANT. The CONSULTANT will also provide last ownership deed of record and existing utility easement deeds for all parcels that have a new acquisition of easements or new land.
2. The CONSULTANT shall be responsible for staking and re-staking tentative right of way on individual properties, as required by City staff, during the right of way negotiation and acquisition phase of the project.
3. The CONSULTANT shall prepare right of way plans, which may be separate drawings from those used for design and construction details. The right of way plans shall show alignment, geometric design, removal of improvements, drainage facilities, property lines and ownership, ¼ ¼ section lines, subdivision lot lines, other land survey information, street lines and existing right of way and easements.
4. The CONSULTANT shall include any plan details, which will require additional right of way or easements during the construction phase of the project such as bypasses, temporary erosion control, etc. Areas of new right of way, permanent easements and/or temporary easements required from each individual property owner must be denoted underneath the Parcel Number and Name on each individual tract.
5. Right of way plans shall be submitted to the City for review and approval as required by negotiated schedule followed by review and approval as required by MoDOT. The right of way plans shall be at the same scale as the construction plans. The right of way plans shall include any design details that control the width of right of way and necessary easements.
6. The following minimum design features shall be included on the right of way plans:
a. Title sheet with appropriate project limits, access note and traffic data completed.

c. Plan and Profile Sheets at 1”=50’ horizontal and 1”=10’ vertical. The CONSULTANT shall finalize and detail the horizontal and vertical improvements, and shall clearly describe important design notes and features on all plan sheets in standard MoDOT format.

Right of Way Plans. The Consultant will determine the easements (temporary and permanent) and right- of-way required to construct the project. Temporary construction easements will be acquired in areas outside the proposed right-of-way acquisition. Temporary construction easements will be acquired to construct driveways or make improvements to personal property beyond the existing or proposed right of way. The City landbase files and title researches provided by the City will be used by the Consultant to determine the existing right-of-way and to design the easements and additional right-of-way needed to construct the project. The Consultant shall prepare project base files and plan sheets in accordance with the City of Joplin CADD standards. This includes, but not limited to, the following sheets: • Title Sheet • Typical Sheet • Plan/Profile Sheets • Detail Sheets • R.O.W. and Easement Plan Sheets • Cross Sections • Construction Limits
Right of Way Plans. (KDG and the City) – The City will provide the property ownership and property line information for the project. KDG will prepare a complete set of ROW plans, combined with the raw survey data and design plans, in CDOT format, except for the survey control diagram and monumentation sheet. KDG will need the City’s surveyor’s assistance in creating these two sheets, and these sheets will need to be stamped by the PLS in charge of the survey. The City will provide title work, including the preparation of informational title binders on the adjacent property owners. These title binders will identify any existing encumbrances and/or easements on their property.
Right of Way Plans. SLQ shall acknowledge receipt, as at the Closing Date, of a copy of CN's Right-of-way Plans covering the Sherbrooke Line, with such changes as have been made by CN in the ordinary course of business. CN makes no warranty of completeness, currency or accuracy of such Right-of-way Plans, which have been provided to SLQ for informational purposes only. SLQ shall be responsible for any costs associated with the provision of any information or documentation requested by SLQ, including surveys, not in the possession of CN or which CN cannot reasonably provide.
