Right of Way Retracement, Control and Recovery Map , Pre- Construction Record of Survey. Contractor shall retrace existing right-of-way (full width) on NE ▇▇▇▇▇▇▇ Blvd from the intersection with NE ▇▇▇▇ Road northerly for a distance of +/-650-feet and southerly for a distance of +/-550-feet. Contractor shall retrace existing right-of-way on NE ▇▇▇▇ Road (full width) from the intersection with NE ▇▇▇▇▇▇▇ Blvd easterly for a distance of +/-650-feet and westerly for a distance of +/-625-feet. Contractor shall retrace existing right-of-way on NE ▇▇▇▇ Road right of way (north half only) from the intersection with NE Cliff Drive westerly for a distance of +/-1,650-feet to the intersection with NE Eastwood Drive. Contractor shall search all survey records on file with Deschutes County, to reestablish existing centerlines of each right-of-way. Contractor shall: ▪ Calculate and map, as accurately as possible, the adjacent property line (Sideline) of individual properties using record deeds, Records of Survey, and Plats. Property lines (Sidelines) that intersect with right-of-way lines will be shown for reference only and can only be resolved by performing a complete survey of those properties (not included in this scope of work). Research vesting deeds and Record of Surveys, including but not limited to all property surveys, county road surveys, original county road resolutions, section corner surveys, and Donation Land Claim (DLC) surveys. ▪ Identify property ownership within the project limits by researching property deeds and county tax records. ▪ Retain all copies of the research data collected, including but not limited to surveys, deeds, assessors' maps, county road maps, government corner surveys, and horizontal and vertical control data sheets in Contractor’s Project file. ▪ Provide notice to property owners or occupants within and adjoining project limits. ▪ Survey found property corners, property line fences and the existing edges of pavement to establish existing road centerlines and rights-of-way. Contractor shall tie at least one (1) Public Land Survey System (PLSS) corner as necessary to show a relationship to the road centerlines. Contractor shall provide at least one (1) PLSS corner tie for ROW descriptions and the filing of a Record Survey. ▪ Include Sidelines and existing rights-of-way on the Project Base Map using Contractor’s ROW retracement. ▪ Prepare and file a pre-construction Record of Survey to perpetuate monument locations as required under ORS 209.155.

  • Selection of Subcontractors, Procurement of Materials and Leasing of Equipment The contractor shall not discriminate on the grounds of race, color, religion, sex, national origin, age or disability in the selection and retention of subcontractors, including procurement of materials and leases of equipment. The contractor shall take all necessary and reasonable steps to ensure nondiscrimination in the administration of this contract. a. The contractor shall notify all potential subcontractors and suppliers and lessors of their EEO obligations under this contract. b. The contractor will use good faith efforts to ensure subcontractor compliance with their EEO obligations.

  • Periodic Review of Costs of Environmental Compliance In the ordinary course of its business, the Company conducts a periodic review of the effect of Environmental Laws on the business, operations and properties of the Company and its subsidiaries, in the course of which it identifies and evaluates associated costs and liabilities (including, without limitation, any capital or operating expenditures required for clean-up, closure of properties or compliance with Environmental Laws or any permit, license or approval, any related constraints on operating activities and any potential liabilities to third parties). On the basis of such review and the amount of its established reserves, the Company has reasonably concluded that such associated costs and liabilities would not, individually or in the aggregate, result in a Material Adverse Change.

  • SITE VISITS AND RECORD REVIEW The Applicant shall allow authorized employees of the District, the Comptroller, the Appraisal District, and the State Auditor’s Office to have reasonable access to the Applicant’s Qualified Property and business records from the Application Review Start Date through the Final Termination Date, in order to inspect the project to determine compliance with the terms hereof or as necessary to properly appraise the Taxable Value of the Applicant’s Qualified Property. A. All inspections will be made at a mutually agreeable time after the giving of not less than ninety-six (96) hours prior written notice, and will be conducted in such a manner so as not to unreasonably interfere with either the construction or operation of the Applicant’s Qualified Property. B. All inspections may be accompanied by one or more representatives of the Applicant, and shall be conducted in accordance with the Applicant’s safety, security, and operational standards. Notwithstanding the foregoing, nothing contained in this Agreement shall require the Applicant to provide the District, the Comptroller, or the Appraisal District with any technical or business information that is proprietary, a trade secret, or is subject to a confidentiality agreement with any third party.

  • Environmental Compliance and Reports Borrower shall comply in all respects with any and all Environmental Laws; not cause or permit to exist, as a result of an intentional or unintentional action or omission on Borrower’s part or on the part of any third party, on property owned and/or occupied by Borrower, any environmental activity where damage may result to the environment, unless such environmental activity is pursuant to and in compliance with the conditions of a permit issued by the appropriate federal, state or local governmental authorities; shall furnish to Lender promptly and in any event within thirty (30) days after receipt thereof a copy of any notice, summons, lien, citation, directive, letter or other communication from any governmental agency or instrumentality concerning any intentional or unintentional action or omission on Borrower’s part in connection with any environmental activity whether or not there is damage to the environment and/or other natural resources. Additional Assurances. Make, execute and deliver to Lender such promissory notes, mortgages, deeds of trust, security agreements, assignments, financing statements, instruments, documents and other agreements as Lender or its attorneys may reasonably request to evidence and secure the Loans and to perfect all Security Interests.
