Right to Join and Participate. 4.2.1 Employees shall have the right to join or to refrain from joining the Union. Neither the employer nor the Union shall discriminate against or interfere with the rights of employees to become members of the Union and, further, there shall be no discrimination against any employee because of Union membership or non- membership. The Union shall, in its responsibility as exclusive representative of the employees, represent all employees without discrimination, interference, restraint or coercion. 4.2.2 The Union shall, in its capacity as exclusive representative, represent all employees included within these bargaining units without discrimination. It is expressly recognized by the parties to this Agreement that the Union, on behalf of individual employees, may enter into agreements with the Board of Education to settle grievances or other disputes. In the event that the parties enter into such agreements to this Agreement, the Board of Education shall be relieved of any obligation to pursue the grievance or dispute further under the grievance procedure contained in this Agreement.
