Common use of Right to Record Clause in Contracts

Right to Record. SolarStorage has the right to record a memorandum of easement to reflect the Easement and the recording costs for the same will be borne by SolarStorage. Customer shall cooperate in good faith with SolarStorage in signing and recording such memorandum of easement. SolarStorage also has the right to record or to have recorded a fixture filing, without prior consent of the Customer, that provides that the System is SolarStorage’s (or a SolarStorage’s designee’s) personal property and may not be sold, leased, assigned, mortgaged, pledged or otherwise alienated or encumbered by Customer or by any person acting for, on behalf of, through, or for the benefit of Customer or a Customer’s successor in interest.
