Common use of Rights during Investigation Clause in Contracts

Rights during Investigation. (a) An employee has the right to be accompanied by a Union Representative when filing a complaint under the Employer’s ‘Respectful Workplace Policy’ or any successor policy thereto. (b) Where an employee files a formal complaint under the LCBO’s ‘Respectful Workplace Policy’ or any successor policy thereto, the Employer recognizes the importance of concluding the investigation into that complaint in an expeditious manner. As such it is the goal of the Employer to fully investigate and make a determination within forty-five (45) days of the date that the formal complaint was filed. A written summary of the findings shall be provided to the complainant and respondent.
