Roads and Trails a. Individual roads and trails will be exempted from the requirement for total reclamation if either: i. It can be demonstrated that an agency of the Crown has accepted responsibility in writing for the operation, maintenance and reclamation of the road or trail; or ii. Roads and Trails. Use roads and trails on the Property as follows (as used in this paragraph, “road” means a hard-surfaced, open way for 4-wheeled vehicles, persons, and animals, and “trail” means a marked or established single-track route for 2-wheeled vehicles, persons and animals): 5.6.1. Use, maintain, relocate, or remove, the existing roads and trails shown in the Inventory; and 5.6.2. Construct, maintain, and use new roads and trails (including bridges) as necessary to provide access to reserved buildings, for reserved agricultural uses, and/or for reserved recreational uses. 5.6.3. Grantor may only construct new roads and trails with ▇▇▇▇▇▇▇’s prior written approval, which Grantee will not withhold unreasonably. Grantor may not pave trails, but may cover them with gravel, woodchips, or similar materials. Grantor may not remove any trees to construct new roads and trails. Any area disturbed to construct, use, maintain, relocate or remove existing or new roads and trails will be the minimum amount reasonably necessary and be promptly restored according to the provisions of Section 5.

Roads and Trails. 1. New undertakings that involve road construction, reconstruction, and improvement projects that may impact heritage resources must follow the procedures outlined in 36 CFR 800 or Stipulations V. through VII. of this Agreement. 2. If an historic property is traversed by facilities or improvements created within the last 50 years, these existing facilities or improvements may be used for a project so long as their use is consistent with the function for which they were created and that use does not further affect heritage resources (e.g., the use of existing access roads that use or traverse linear sites such as railroad grades). Such continued use shall be considered to have no effect on historic properties. 3. Continued or reuse of a Forest road or trail will not affect a property and no case-by case consultation with the SHPO is necessary under the following circumstances: a. when a physical barrier along the traveled way (fences, boulder barriers, existing pavement) prevents further damage to heritage resources; b. where the roadway or trailway was cut through or is situated below a property (e.g., archaeological deposit) through which it passes. The absence of a property (e.g., cultural deposit) may be documented by field work in the form of surface observations and/or subsurface test excavation. These excavations may include shovel tests, excavation units, or auger borings; c. placement of foreign, non-archaeological material (padding) over an archaeological deposit within the traveled way only will not require NRHP evaluation of the archaeological deposit if: i. the pad depth does not exceed two feet; ii. the Forest Engineer has determined that two feet of padding is sufficient to ensure no further erosion or downcutting of the pre-pad road surface, taking into consideration variables such as the seasonality, purpose, and intensity of road use; iii. the archaeological site has been recorded to contemporary professional standards, as described in Attachment 6 of this Agreement. iv. pads must be constructed in such a manner that they can be placed without damage to the underlying deposit and easily distinguished from the underlying deposits.

Roads and Trails. There shall be no construction of roads, trails or walkways on the Conservation Easement Area; nor enlargement or modification to existing roads, trails or walkways. Signage. No signs shall be permitted on or over the Conservation Easement Area, except the posting of no trespassing signs, signs identifying the conservation values of the Conservation Easement Area, signs giving directions or proscribing rules and regulations for the use of the Conservation Easement Area and/or signs identifying the Grantor as owner of the Conservation Easement Area. Dumping or Storage. Dumping or storage of soil, trash, ashes, garbage, waste, abandoned vehicles, appliances, machinery or hazardous substances, or toxic or hazardous waste, or any placement of underground or aboveground storage tanks or other materials on the Conservation Easement Area is prohibited.

Roads and Trails. For public and recreational road and trail construction and reopenings, offsets actions will include:

Roads and Trails. The construction, reconstruction, or replacement of any roads and trails is prohibited, except as set forth in the remainder of this Paragraph 3(C). The Grantor may maintain roads and trails that exist on the Property as of the date of this Conservation Easement at the levels of improvement for each that exist as of the date of this Conservation Easement. The Grantor may construct and maintain new roads and trails on the Property, provided that: (1) such new roads and trails, if constructed on the Rangeland, shall be reasonably necessary for the permitted Ranching Operations; (2) the Grantor shall have obtained the Foundation’s prior written approval, which shall not be unreasonably withheld, conditioned, or delayed, for the construction of such new roads and trails; and (3) such new roads and trails shall not be constructed within the high water mark of any natural or artificial water feature and shall also comply with all terms and conditions of this Conservation Easement.

Roads and Trails. Except for Required Actions provided in Section 7 or as required to implement a Required Action, or in the case of an emergency or other occurrence affecting the safety of persons and/or property, there shall be no construction of any new roads or trails on the Property; provided, however, the construction of new roads and trails (or the relocation of existing road and trails) on the Property to protect, preserve or enhance the Beneficial Public Values shall be permitted with Grantee's prior written approval in accordance with Section 7, as required. As used herein, the term "construction" shall not include the creation of roads or trails through repeated use, although such activities shall be governed by this Easement.

Roads and Trails. The construction, reconstruction, or replacement of any roads and trails is prohibited, except as set forth in the remainder of this Paragraph 2(B). Grantor may maintain roads and trails that exist on the Property as of the date of this Conservation Easement at the levels of improvement for each that exist as of the date of this Conservation Easement. Grantor may construct and maintain new roads and trails on the Property, provided that: (1) such new roads and trails, if constructed on the Property, shall be reasonably necessary for the permitted Ranching Operations or to effectuate the Conservation Purposes of this Conservation Easement; (2) the Grantor shall have obtained the Grantee’s and Caltrans prior written approval, which shall not be unreasonably withheld, conditioned, or delayed, for the construction of such new roads and trails; (3) such new roads and trails shall not be constructed within two hundred fifty (250) feet of the high water mark of any vernal pool, shall not impair the quality of any vernal pool, and shall comply with all terms and conditions of this Conservation Easement, including, without limitation, Paragraph 7 of Exhibit C; and (4) such new roads and trails are constructed so as not to impair the Conservation Values of the Property.

Roads and Trails. Maintenance of existing Roads and Trails is permitted. “Roads” shall mean any road that is graded, improved or maintained, including seasonal unimproved roads and two-track roads. “Trails” shall mean any unimproved or improved path, or paved or unpaved trail constructed or established by human use, but shall not include game trails established and used by wildlife only.
