Sampling and Testing Clause Samples

The Sampling and Testing clause establishes the procedures and requirements for examining and evaluating materials, products, or work to ensure they meet specified standards. Typically, this clause outlines who is responsible for conducting tests, the frequency and methods of sampling, and the standards or benchmarks that must be met. For example, it may require random samples of delivered goods to be tested in a certified laboratory before acceptance. Its core practical function is to ensure quality control and compliance with contractual specifications, thereby reducing the risk of defective or non-conforming goods or services.

Sampling and Testing. Prior to purchasing any of the Coals comprising any Coal Blend selected by the Coal Committee (except for the sampling and testing thereof for the purpose of determining whether such coals should be incorporated into a Coal Blend), sampling and testing of all such Coals shall be performed in a manner reasonably acceptable to Off-Taker and Provider, and they shall be provided with a reasonable opportunity to review and, if appropriate, object to such test results. In addition, Provider or its designee shall also maintain a quality control program in respect of Coal blending in accordance with generally accepted industry practice, which shall be reasonably satisfactory to Off-Taker. Such quality control program is to include, without limitation, procedures for sampling, testing and reporting Coal Blend quality charged into the coke ovens at the Plant.
Sampling and Testing. THE FOLLOWING IS ADDED TO THE FIRST PARAGRAPH: Ensure that the mix meets the requirements as specified in 902.02.04.A, otherwise the RE or ME will reject the material. THE SECOND PARAGRAPH IS CHANGED TO: During production, the ME will take one random acceptance sample from each 700 tons of production to verify composition. Conduct air voids and draindown tests as directed by the ME. THE FOURTH PARAGRAPH IS CHANGED TO: The ME will perform sampling according to NJDOT B-2 or ASTM D 3665, and will perform testing for composition according to AASHTO T 308 or NJDOT B-5. Perform testing for air voids according to AASHTO T 209 and either NJDOT B-6 or AASHTO T 331. Perform testing for draindown according to NJDOT B-7 or NJDOT B-8.
Sampling and Testing. (i) The District agrees that the City may, at its option and expense, sample wastewater discharges within the District System at: (1) the site of discharge; (2) the point of entry; and (3) other locations as required for the purpose of determining the source, type, and strength of discharge. Any damages done to the District’s System or to the property of the District or third parties during the course of City sampling under this Subsection 4(h) will be immediately and fully repaired or replaced by the City. (ii) The District will make necessary arrangements and provide assistance to the City in obtaining lawful access to sampling points within areas served by District. (iii) The District will disconnect any of its individual customers found in violation of allowable discharges or any of its individual customers who refuse access for the purpose of sampling from the District system in accordance with applicable regulations of District and of the City. (iv) In addition to other samples taken and tests made on an as required basis, the City will regularly take 24-hour composite samples of wastewater discharges at the point of entry no less frequently than semiannually. The City will be solely responsible for the costs of sampling and testing at the point of entry. (v) The City will provide the District with a copy of the results of each sample test within thirty (30) days of the date of taking of the sample.
Sampling and Testing. A qualified independent laboratory, reasonably acceptable to both Parties, shall perform sampling, proximate analysis (including moisture analysis), total sulfur analysis, oxidation analysis, plastic behavior analysis, and petrography of each Coal shipment. Such sampling, analysis and petrography shall be performed in accordance with ASTM Standards. The results of such analysis and petrography shall be promptly provided to each member of the Coal Committee in Writing, and shall be used for determining compliance with the Coal Blend Standards in respect of each Coal Blend.
Sampling and Testing. THE FOLLOWING IS ADDED TO THE FIRST PARAGRAPH: Ensure that the mix meets the requirements as specified in 902.02.04.A, otherwise the RE or ME will reject the material. THE SECOND PARAGRAPH IS CHANGED TO: During production at the plant, the ME will take a sample from each 700 tons of production to verify composition and air voids. Conduct draindown, VCAmix, VCAdry, and VMA testing as directed by the ME. Perform tests according to AASHTO R 46. THE FOURTH PARAGRAPH IS CHANGED TO: The ME will perform sampling according to NJDOT B-2 or ASTM D 3665, and will perform testing for composition according to AASHTO T 308, or NJDOT B-5. The ME will determine bulk specific gravity of the compacted sample according to AASHTO T 166 or AASHTO T 331. The ME will use the most current QC maximum specific gravity test result, obtained according to AASHTO T 209, in calculating the volumetric properties of the SMA. Perform testing for draindown according to AASHTO T 305.
Sampling and Testing. Prior to purchasing any of the Coals comprising any Coal Blend selected by the Coal Committee (except for purchases made for the purpose of sampling and testing thereof), sampling and testing of all such Coals shall be performed in a manner reasonably acceptable to the Parties, and each Party shall be provided with a reasonable opportunity to review and, if appropriate, object to such test results. Such sampling and testing shall include the collection of representative samples of meaningful quantities of each potential Coal to be prepared and tested in a laboratory approved by the Coal Committee for moisture, ash, sulfur, volatile matter, PSI (free swelling index), oxidation (via petrographic techniques and US Steel method), ash mineral analysis (including P205, Na20, K20 and chlorine) and other parameters as agreed to from time to time. The Seller and Purchasers will use their best commercial efforts to have the cost of such analysis be to the account of the potential Coal supplier(s). Seller shall arrange for similar sampling and testing to be carried out with respect to Coals actually purchased by Seller for the production of coke and each Party shall be provided a reasonable opportunity to review and, if appropriate, object to such test results. Upon the reasonable request of Purchasers, Seller shall process blends of Coals for trial purposes at the Plant.
Sampling and Testing. ▇. ▇▇▇▇▇▇▇ of the aggregates for mix design and determination of suitability shall be taken under the supervision of Engineer and delivered to the laboratory, well in advance of the scheduled placing of concrete. Records of tests which have been made on proposed aggregates and on concrete made from this source of aggregates shall be furnished to Engineer in advance or the work for use in determining aggregate suitability. The costs of all such tests, sampling, etc., shall be borne by Contractor.
Sampling and Testing. THE FOLLOWING IS ADDED TO THE FIRST PARAGRAPH:
Sampling and Testing. 13.1. The Framework Provider shall comply with all procedures for sampling and testing of Fuel as detailed in paragraphs 12 to 22 of the Statement of Requirement (StOR) at Annex B. 13.2. The Authority reserves the right to conduct any additional sampling and testing it requires, at any point prior to the Framework Provider receiving written confirmation from the Authority of compliance to the relevant specification after final quality testing (as detailed in the StOR at Annex B). The Authority shall be liable for the cost of any additional testing, unless any sample taken from the Fuel is found not to comply with the requirements of the relevant Fuel specification. If the sample taken does not comply with the relevant Fuel specification, the Framework Provider shall be liable for the costs of the additional sampling and /or testing. Additionally, the Fuel may be rejected in accordance with DEFCON 524 – Rejection and Special Condition 14 - Rejection. 13.3. Nothing in this Special Condition shall prejudice any other right or remedy available to the Authority, whether express or implied.
