Scheduling of Vacation. Vacation leave shall be scheduled subject to the operational requirements of the University and in accordance with the following: 1. An employee may request that an absence for illness, disability, or personal reasons (for example, special or religious holidays) be charged to vacation. Such request shall not be unreasonably denied, however, vacation credit shall not be used prior to the time it is accrued. 2. Vacation schedules shall be established in each shop or work location on the basis of seniority in an employee's classification and vacation schedules shall be posted in each shop or work location. An employee may split his/her vacation requests, but preference according to seniority shall only apply to an employee's first such request. Vacation requests will be submitted during the month of March for vacations to be taken between April 1 of the same year and March 30 of the following year. Upon request, an employee shall be granted vacation before the employee's accrued credit reaches the maximum which the employee can accumulate. An employee shall be notified sixty (60) calendar days and thirty (30) calendar days before reaching the maximum vacation credit which he/she can accumulate. If an employee cannot schedule vacation due to operational considerations that employee shall have, on a one- time basis, an additional four (4) months within which he/she must take vacation to bring his/her accruals below the maximum. Vacation credits shall continue to accrue during this four (4) month period. 4. Occasional unscheduled vacation days may be granted subject to the operational requirements of the University, provided that they are requested at least four (4) work days in advance. 5. Personal emergency vacation days may be granted at the discretion of supervision. The request for such emergency vacation shall be made either orally or in writing through the immediate supervisor, and may be reviewed by a designated University manager. Verification of the emergency may be required and, if required, must be submitted to the designated University manager prior to vacation payment authorization. 6. Except as provided in Section I.2 below, an employee shall not be paid vacation for the same period that he/she is working and on pay status in the employee's present position, or any other position paid by University funds. 7. An employee may split his/her accruals below their vacation time, but preference according to seniority shall only apply to one of the maximum. Vacation credits shall continue to accrue during this four (4) month periodtwo requests for vacation in that calendar year. 47. Arrangements for vacation plansmust be made in advance in a timely fashion and with the approval of the employer. Every effort will be made to grant vacation at the time and in the amount requested provided, however, it does not affect the operations of the facility in a detrimental manner. In the event that a request for vacation is made simultaneously by more than one person under such circumstances so as to hinder the operations of the department, the person with the most seniority shall be given preference as to vacation choice. Employees may exchange scheduled vacation with other employees with the approval of the Supervisor. For the purpose of scheduling vacation the following specific terms shall apply. 3a) The scheduling of vacation is prohibited on Thanksgiving Day and from December 24, 25, 31 and January 1 of any year. b) During July and August of each calendar year, employees may be limited to no more than two scheduled weeks of vacation. Upon request, an employee More time may be allowed as staffing needs and requests by other employees allow. There shall be granted no other length limit applied at other times of the year except as staffing needs require. c) Except on Thanksgiving Day and during December 24, 25, 31 and January 1, the following minimum number of bargaining unit employees shall be allowed to schedule vacation at the same time, if requested, per classification and shift. CNAs: AM shift - two (2); PM shift - two (2); NOC shift - one (1) Other classifications per shift: One (1). At management's discretion, based upon staffing needs and request by other employees, more employees may be allowed off at one time. d) Employees shall not be required to find their own replacements in order to schedule vacation unless they request vacation after the work schedule for that time period has been posted. e) Request for use of vacation should be made at least two weeks before the employee's accrued credit reaches the maximum which the employee can accumulate. No vacation choices shall be accepted after May 31st. Vacation schedules may be adjusted by the Employer to accommodate seasonal operations, significant revisions in organization, work assignments or the use of personnel in particular ranks. Conflicts in scheduling will be resolved in favor of the most senior employee. The Chief of Police or his/her designee maintains the right to approve or otherwise alter any vacation schedule for emergency purposes. No employee shall be entitled to priority in selecting his/her annual vacation leave for more than two (2) weeks annually. Employees are strongly encouraged that vacation days be taken and in any event cannot be carried over beyond the fiscal year following that in which the vacation days are earned. Therefore, all vacation leave must be used before April 30th. However, employees may, at their selection, cash-in up to two (2) weeks of accrued vacation time which shall be payable to them during the first payroll period in December, however, they must cash-in within the present one (1) week minimum increment. In order to be eligible for this cash-in, the employee must serve notice to the Employer by May 31st of each year when they are submitting their annual vacation credit requests.
