SCHOOL BUS REQUIREMENTS. The terms and conditions in this Section (i.e., III.2 through III.2.10) shall be considered minimum requirements for a School Bus. Appendix C: School Bus Contract Documents, Number 2: Contract Pricelist, includes supplemental required specifications for each Item. School Buses delivered to an Authorized User in a condition that would be considered unacceptable to a reasonable person may be rejected (see also Appendix B §36 Rejected Product). Criteria which determine this acceptance level shall include, but not be limited to, the general appearance of the interior and exterior of the School Bus for completeness and quality of workmanship, lubrication and fluid levels, with any leaks corrected, mechanical operation of the School Bus and all electrical components operational. Equipment specified to be furnished and installed shall conform to all applicable industry standards.

These requirements do not apply to micro-purchases ($10,000 or less, except for construction contracts over $2,000). If a Recipient or any Third-Party Participant that has operated school bus service in violation of FTA’s School Bus laws and regulations, FTA may: (1) Require the Recipient or Third-Party Participant to take such remedial measures as FTA considers appropriate, or (2) Bar the Recipient or Third-Party Participant from receiving Federal transit funds.
SCHOOL BUS REQUIREMENTS. The Contractor shall only provide the Optional Equipment and Additional Body Sections awarded, or approved by OGS and NYS DOT after award (see Section III.8 Replacement Product and Product Additions), under the Contract. Federal transit laws, specifically 49 U.S.C. § 5323(f); 2. FTA regulations, “School Bus Operations,” 49 CFR Part 605; 3. Any other Federal School Bus regulations; or 4. Federal guidance, except as FTA determines otherwise in writing. If Contractor violates this School Bus Agreement, FTA may: 1. Bar the Contractor from receiving Federal assistance for public transportation; or 2. Require the contractor to take such remedial measures as FTA considers appropriate. When operating exclusive school bus service under an allowable exemption, the contractor may not use federally funded equipment, vehicles, or facilities. The Contractor should include the substance of this clause in each subcontract or purchase under this contract that may operate public transportation services.
