SCOPE OF ARCHITECT’S SERVICES. 1. The ARCHITECT’s services include those described in this Article and include structural, civil, mechanical and electrical engineering and landscape architecture services and any other services necessary to produce a reasonably complete and accurate set of Construction Documents defined as including, but not limited to, the following: The agreement between DISTRICT and contractor awarded the PROJECT (“Contractor”), general and supplementary conditions of the contract between DISTRICT and contractor, drawings, specifications, addenda and other documents listed in the agreement, and modifications issued after execution of the DISTRICT and Contractor Contract. 2. The ARCHITECT shall assist the DISTRICT in obtaining required approvals from governmental agencies responsible for electrical, gas, water, sanitary or storm sewer, telephone, public utilities, as well as the Division of the State Architect (DSA). 3. The ARCHITECT shall be responsible for determining the capacity of existing utilities, and/or for any design or documentation required to make points of connection to existing utility services that may be located on or off the PROJECT site and which are required for the PROJECT. 4. The ARCHITECT shall provide a PROJECT description which includes the DISTRICT’s needs, program and the requirements of the PROJECT prior to preparing preliminary designs for the PROJECT. 5. The ARCHITECT shall provide a written preliminary evaluation of the DISTRICT’s PROJECT schedule and construction budget requirements. Such evaluation shall include alternative approaches to design and construction of the PROJECT, evaluation and application of Educational specification requirements under Education Code Section 17251 and under Title 5, California Code of Regulations Section 14000 et seq. 6. The ARCHITECT shall provide planning surveys, site valuations and comparative studies of prospective sites, buildings or locations. 7. The ARCHITECT shall attend regular PROJECT coordination meetings between the ARCHITECT, its Consultants, the DISTRICT’s representative(s), and other Consultants of the DISTRICT during PROJECT development. 8. The ARCHITECT shall make revisions in Drawings, Specifications, the PROJECT Manual or other documents when such revisions are necessary due to the ARCHITECT’s failure to comply with approvals or instructions previously given by DISTRICT, including revisions made necessary by adjustments in the DISTRICT’s program or PROJECT Budget. 9. The ARCHITECT shall provide services required due to programmatic changes in the PROJECT including, but not limited to, size, quality, complexity, method of bidding or negotiating the contract for construction. 10. The ARCHITECT shall provide services in connection with the work of a construction manager or separate consultants retained by DISTRICT. 11. The ARCHITECT shall provide detailed estimates of construction costs at no additional cost to DISTRICT as further described in Articles V and VI. 12. The ARCHITECT shall provide detailed quantity surveys which provide inventories of material, equipment or labor. 13. The ARCHITECT shall provide analyses of DISTRICT ownership and operating costs for the PROJECT. 14. The ARCHITECT shall provide interior design and other services required for or in connection with graphics and signage. All other interior design services are addressed under Article III as an additional service. 15. The ARCHITECT shall visit suppliers, fabricators, and manufacturers’ facilities such as for carpet, stone, wood veneers, standard or custom furniture, to review the quality or status of items being produced for the PROJECT. 16. The ARCHITECT shall cooperate and consult with DISTRICT in use and selection of manufactured items on the PROJECT, including, but not limited to, paint, hardware, plumbing, mechanical and electrical equipment, fixtures, roofing materials, and floor coverings. All such manufactured items shall be standardized to DISTRICT’s criteria to the extent such criteria do not interfere with PROJECT design and are in compliance with the requirements of Public Contract Code §3400. 17. The ARCHITECT shall certify to the best of its information pursuant to 40 Code of Federal Regulations §763.99(a)(7), that no asbestos-containing material was specified as a building material in any construction document for the PROJECT and will ensure that contractors provide DISTRICT with a certification that all materials used in the construction of any school building are free from any asbestos-containing building materials (“ACBM’s”). ARCHITECT shall include statements in specifications that materials containing asbestos are not to be included. This certification shall be part of the final PROJECT submittal. 18. The ARCHITECT shall consider operating or maintenance costs when selecting systems for the DISTRICT. The ARCHITECT shall utilize grants and outside funding sources and work with the DISTRICT to utilize and consider funding from grants and alternative funding sources. 19. The ARCHITECT shall prepare for and make formal presentations to the Governing Board of DISTRICT, attend public hearings and other public meetings. In addition, ARCHITECT shall attend and assist in legal proceedings that arise from errors or omissions of the ARCHITECT. 20. The duties, responsibilities and limitations of authority of the ARCHITECT shall not be restricted, modified or extended without written agreement between the DISTRICT and ARCHITECT. 21. The ARCHITECT shall comply with all federal, state and local laws, rules, regulations and ordinances are applicable to the PROJECT. 22. The ARCHITECT shall have access to the work at all times.

SCOPE OF ARCHITECT’S SERVICES. 1. The ARCHITECT’s 's services include consist of those described in this paragraphs 2 through 30 of Article II and further delineated in Exhibit A, and include architectural, structural, civilmechanical, mechanical electrical, engineering services, and electrical engineering and landscape architecture services and any other cost estimating services necessary to produce a reasonably complete and accurate set of Construction Documents defined as including, but not limited to, the following: The agreement between DISTRICT and contractor awarded the PROJECT (“Contractor”), general and supplementary conditions of the contract between DISTRICT and contractor, drawings, specifications, addenda and other documents listed in the agreement, and modifications issued after execution of the DISTRICT and Contractor Contractconstruction documents.
2. The ARCHITECT has been selected to perform the work herein because of the skills and expertise of key individuals. The ARCHITECT shall assist the DISTRICT in obtaining required approvals from governmental agencies responsible for electrical, gas, water, sanitary or storm sewer, telephone, public utilitiesdesignate ▇▇▇▇ ▇▇▇▇▇▇▇, as well Principal in Charge, ▇▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇ as Project Manager and ▇▇▇▇ ▇▇▇▇ as Project Architect. Consultants include: Fundament & Associates MEP Engineer - Paulo Fundament; VCA/YKN Structural Engineer – Young Nam. So long as their performance continues to be acceptable to the Division DISTRICT, these named individuals shall remain in charge of the State Architect (DSA)Project. Additionally, the ARCHITECT must furnish the name of all other key people in ARCHITECT’s firm that will be associated with the Project. If the designated project manager or any other designated lead or key person fails to perform to the satisfaction of the DISTRICT, then upon written notice the ARCHITECT will have 10 working days to remove that person from the Project and replace that person with one acceptable to the DISTRICT. A project manager and all lead or key personnel for any SUBCONSULTANT must also be designated by the ARCHITECT and are subject to all conditions previously stated in this paragraph.
3. The ARCHITECT shall be responsible for determining ascertain the capacity DISTRICT's needs and the requirements of existing utilities, and/or for any design or documentation required to make points of connection to existing utility services that may be located on or off the PROJECT site and which are required shall arrive at a mutual written understanding of such needs and requirements with the DISTRICT, prior to drafting preliminary designs for the PROJECT.
4. The ARCHITECT shall provide a PROJECT description which includes the DISTRICT’s needs, program and the requirements of the PROJECT prior to preparing preliminary designs for the PROJECT.
5. The ARCHITECT shall provide a written preliminary evaluation of the DISTRICT’s PROJECT 's PROJECT, schedule and construction budget requirements. , each in terms of the other, subject to the limitations set forth in Article V. Such evaluation shall include alternative approaches to design and construction of the PROJECT.
5. The ARCHITECT has submitted a list of qualified engineers for the PROJECT. ARCHITECT shall ensure that each engineer places his or her name, evaluation seal and application signature on all drawings and specifications prepared by said engineer. The ARCHITECT is responsible for the management of Educational specification requirements under Education Code Section 17251 and under Title 5, California Code their consultants in order to meet the terms of Regulations Section 14000 et seqall phases of this agreement.
6. The ARCHITECT shall make a written record of all meetings, conferences, discussions and decisions made between or among the DISTRICT, ARCHITECT and Contractor during all phases of the PROJECT and concerning any material condition in the requirements, scope, performance and/or sequence of the work. The ARCHITECT shall provide planning surveysa draft copy of such record to the DISTRICT for review and comment, site valuations make adjustments and comparative studies of prospective sites, buildings or locationsprovide a final copy to the DISTRICT and a copy to the Contractor upon request.
7. The ARCHITECT shall attend regular PROJECT coordination meetings between the ARCHITECTprepare, its Consultants, for approval by the DISTRICT’s representative(s), Schematic Design Documents consisting of drawings and other Consultants documents illustrating the scale and relationship of PROJECT components. The ARCHITECT and their consultant shall employ Building Information Modeling (BIM) using Revit and make regular posting to the DISTRICT during PROJECT developmentwebsite throughout the design process. Commissioning and Energy Modeling are outside the parameters of this agreement and will be services employed by the District. These documents shall comply with all applicable laws, statutes, ordinances, codes, rules and regulations currently existing and as amended, enacted, issued or adopted in the future which are applicable to these documents.
8. The ARCHITECT shall make revisions in Drawings, Specifications, the PROJECT Manual or other documents when such revisions are necessary due submit to the ARCHITECT’s failure to comply with approvals or instructions previously given by DISTRICT a written preliminary estimate of the construction cost and shall advise the DISTRICT, including revisions made necessary by in writing, of any adjustments in to the DISTRICT’s program or PROJECT Budgetestimate of Construction Cost.
9. The ARCHITECT shall provide services required due to programmatic changes in review existing as-builts provided by the PROJECT includingDistrict, but not limited to, size, quality, complexity, method investigate existing conditions or facilities and make measured drawings of bidding such conditions or negotiating the contract for constructionfacilities where needed and input into Revit.
10. The Based on the approved Schematic Design Documents and any adjustments authorized by the DISTRICT, the ARCHITECT shall provide services in connection with prepare, for approval by the work DISTRICT, Design Development Documents consisting of a construction manager or separate consultants retained by DISTRICTdrawings and other documents to describe the size and character of the PROJECT as to architectural, structural, mechanical and electrical systems, materials, and such other elements as may be appropriate.
11. The Based on the approved Design Development Documents and any further adjustments authorized by the DISTRICT, the ARCHITECT shall provide detailed estimates prepare, for approval by the DISTRICT, Construction Documents consisting of drawings and specifications setting forth in detail the requirements for the construction costs at no additional cost to DISTRICT as further described in Articles V and VIof the PROJECT.
12. The ARCHITECT shall provide detailed quantity surveys which provide inventories file documents required for the approval of material, equipment or laborgovernmental authorities having jurisdiction over the PROJECT including funding submittals with the DISTRICT's assistance. The DISTRICT shall pay all fees required by such governmental authorities.
13. The ARCHITECT shall prepare all necessary bidding information and bidding forms required by the DISTRICT and shall assist the DISTRICT in preparing the conditions of the Contractor's contract and coordinating same with the technical specifications. Plans or specifications, which include a requirement that the Contractor provide analyses operation manuals and adequate training for the DISTRICT in the operation of mechanical, electrical, heating and air conditioning systems installed by the Contractor, shall be part of the bid documents prepared by the ARCHITECT.
14. The ARCHITECT, following the DISTRICT's approval of the Construction Documents and of the latest preliminary estimate of Construction Cost, shall assist the DISTRICT ownership and operating costs in obtaining bids for the PROJECT.
1415. The ARCHITECT If the lowest bid exceeds the budget for the PROJECT (or exceeds the budget by a certain percentage), the ARCHITECT, in consultation with and at the direction of the DISTRICT, shall provide interior design and other services required for or such modifications in connection with graphics and signage. All other interior design services are addressed under Article III the Construction Documents as an additional service.
15. The ARCHITECT shall visit suppliers, fabricators, and manufacturers’ facilities such as for carpet, stone, wood veneers, standard or custom furniture, necessary to review bring the quality or status cost of items being produced for the PROJECTPROJECT within its budget.
16. 2018. The duties, responsibilities and limitations of authority of the ARCHITECT shall not be restricted, modified or extended without written agreement between the DISTRICT and ARCHITECT.
19. The ARCHITECT shall be the DISTRICT's representative during construction and shall advise and consult with the DISTRICT until final payment to the Contractor is due. The ARCHITECT shall have authority to act on behalf of the DISTRICT only to the extent provided in this AGREEMENT unless otherwise modified in writing.
20. The ARCHITECT shall visit the site not less than once per week while work is in progress, and as often as necessary and appropriate to the stage of construction, to inspect the site and work; to familiarize himself/herself with the progress and quality of the work; and to determine for the DISTRICT's benefit and protection if the work is proceeding in accordance with the construction contract and schedule. On the basis of his/her on-site observations and inspections as an ARCHITECT, the ARCHITECT shall keep the DISTRICT informed of the progress and quality of the work and he/she shall use reasonable care to guard the DISTRICT against defects and deficiencies in the work and against the Contractor's failure to carry out the work in accordance with the construction contract and the schedule. The ARCHITECT shall provide services made necessary by major defect or deficiencies in the work of the Contractor which through reasonable care should have been discovered by the ARCHITECT and promptly reported to the DISTRICT and Contractor but which he/she failed to do.
21. The ARCHITECT shall have access to the work at all times.
22. The ARCHITECT shall review and certify the amounts due the Contractor. The ARCHITECT's certification for payment shall constitute a representation to the DISTRICT, based on the ARCHITECT's observations and inspections at the site as provided in paragraph 19, that the work has progressed to the point indicated, that quality of the work is in accordance with the construction contract and that the Contractor is entitled to payment in the amount certified.
23. The ARCHITECT shall reject work which does not conform to the construction contract. The ARCHITECT has authority to require additional inspection or testing of the work in accordance with the provisions of the construction contract, whether or not such work is fabricated, installed or completed.
24. The ARCHITECT shall review and approve or take other appropriate action upon Contractor's submittals of shop drawings, product data, and samples for the purpose of checking for conformance with the construction contract. The ARCHITECT's action shall be taken as to cause no delay in the work, while allowing sufficient time in the ARCHITECT's professional judgment to permit adequate review. When certification of performance characteristics of materials, systems or equipment is required by the construction contract, the ARCHITECT shall be entitled to rely upon such certification to establish that the materials, systems or equipment will meet the performance criteria required by the construction contract.
25. The ARCHITECT shall prepare change orders with supporting documentation and data for the DISTRICT's approval and execution in accordance with the construction contract, and may authorize minor changes in the work not involving an adjustment in the contract sum or an extension of time. The ARCHITECT shall evaluate and make written recommendations regarding Contractor's proposals for possible change orders. DSA change orders shall be submitted for approval on an on-going basis throughout the project.
a. DUE TO THE SHORT CONSTRUCTION PERIOD AND THE TIME DELAY FOR DSA DESIGN CHANGE APPROVALS, THE ARCHITECT IS TO FULLY REVIEW THE PROJECT CONDITIONS AND PROVIDE ACCURATE DOCUMENTS TO AVOID CHANGES DURING CONSTRUCTION.
b. ARCHITECT shall prepare a set of reproducible record drawings showing significant changes in the work made during construction based on marked-up prints, drawings and other data furnished by the Contractor to the ARCHITECT.
26. The ARCHITECT shall inspect the PROJECT to determine the date or dates of substantial completion and the date of final completion, receive and forward to the DISTRICT for the DISTRICT's review all written warranties and related documents required by the construction contract and issue a final certificate for payment upon compliance with the requirements of the construction contract.
27. The ARCHITECT shall evaluate the performance of the Contractor under the requirements of the construction contract when requested in writing by the DISTRICT.
28. ARCHITECT shall provide services in connection with evaluating substitutions proposed by the Contractor and making subsequent revisions to drawings, specifications and other documentation resulting there from.
29. The ARCHITECT shall evaluate and render written recommendations, within a reasonable time on all claims, disputes or other matters at issue between the DISTRICT and Contractor relating to the execution or progress of the work as provided in the construction contract.
30. The ARCHITECT shall comply with all federal, state and local laws, rules, regulations and ordinances that are applicable to the DISTRICT's PROJECT.
22. The ARCHITECT shall have access to the work at all times.
