Common use of SCOPE OF DELIVERY Clause in Contracts

SCOPE OF DELIVERY. Seller agrees to accept deliveries of natural gas belonging to Buyer at Seller's delivery point from SCPC located near Sumter, South Carolina, and to transport Buyer's gas and redeliver to Buyer. Service provided hereunder is in lieu of natural gas provided from Seller's system supply to satisfy Buyer's fuel requirements in Priority-of-Service Category 3D. Buyer agrees that the transportation service is provided on an interruptible basis. Interruptions of transportation service shall be at the sole discretion of Seller or whenever service is interrupted by SCPC or any other transporting pipeline. , DAILY DELIVERIES Seller agrees to accept and transport up to dekatherms, excluding shrinkage volumes, of natural gas on a daily basis. Buyer ▇▇▇▇▇ will notify Seller, in writing, of Buyer▇▇▇▇▇'s intent to transport on Seller's Form CA1by the end of the month and will provide the estimated volumes of gas, at least five (5) working days prior to the beginningof anymonth andwill provide theestimatedvolumesof gas,in dekatherms, to be transportedon adaily basisduring thecalendarmonthtransported on a daily basis during the next calendar month. Buyer hastheright has the right to changethe volumeto betransportedduring themonthon adaily change the volume to be transported during the month on a daily basis. It is Buyer'sresponsibilityto Buyer's responsibility to notify producers,, Seller,andconnectingpipelines regardingany changein transportationvolumes, and connecting pipelines regarding any change in transportation volumes. Sellerwill acceptchangesin Seller will accept changes in daily volumesdispatchedfrom SCPC;however,Sellerreservesthe volumes dispatched from upstream pipelines; however, Seller reserves the right to limit or restrict the volumesacceptedandtransportedat volumes accepted and transported at any time, whenever,, in Seller'ssole Seller's sole opinion, operatingconditionswarranta operating conditions warrant a limitation or restrictionon restriction on the acceptanceor acceptance or delivery of transportationgas'transportation gas. Limitations or restrictionsmay restrictions may be becauseofbecause of, but not limited to, the utilization of deliverability capacity by Seller for Seller's system supply requirements.. , INITIAL SERVICE ▇▇▇▇▇▇ agrees to begin transporting gas for Buyer at 10:00 A.M. Eastern Time on December 1, 2006. ° TERM OF AGREEMENT This Agreement shall become effective on December 1, 2006, and shall continue in full force and effect through November 30, 2007, and from month to month thereafter unless either party shall give written notice of intention to terminate at least thirty (30) days prior to expiration of the original term or any one month extension thereof. . RATE Each month, the rate for daily volumes transported for and delivered to Buyer shall be eighty-three cents ($0.83) per dekatherm. , SHRINKAGE Seller will retain 3% of all volumes delivered to Seller on ▇▇▇▇▇'s behalf for shrinkage and line losses. The volumes retained by Seller will not create or contribute to an imbalance. Seller reserves the right to adjust the shrinkage factor, up or down, to account for actual line losses. ▇▇▇▇▇▇ agrees to give Buyer thirty (30) days written notice of any adjustment. . BALANCING OF VOLUMES The volume of gas received on a daily basis for ▇▇▇▇▇'s account may not equal the volume, less shrinkage, delivered to the Buyer. The result will be deemed an imbalance. ▇▇▇▇▇'s account will be reviewed at the end of each month, or on termination of Transportation Service, or curtailment or discontinuance thereof. If the net imbalance is such that the Buyer has received more gas than was delivered to the Seller during the period under review, Buyer shall be billed for such excess at the Base Rate as specified in the Service Agreement which provides for standby service. If the net imbalance is such that the Buyer has received less gas than was delivered to the Seller, the Seller will buy excess gas at Seller's lowest delivered purchase price in that month from any of Seller's suppliers. Daily volumes transported by Seller shall not exceed the Contract Maximum Daily

Service provided hereunder is in lieu of natural gas provided from Seller's system supply sources. ▇▇▇▇▇'s gas may be transported to Buyer by Seller upon execution of a Transportation Agreement between ▇▇▇▇▇ and Seller. Natural gas is provided hereunder to satisfy Buyer's fuel requirements in Priority-of-Service Category 3D. Buyer when Seller is not providing transportation services. ▇▇▇▇▇ agrees that the transportation service is provided to purchase from Seller, and ▇▇▇▇▇▇ agrees to sell to Buyer, up to a Maximum Daily Quantity of 1,200 dekatherms of natural gas per day on an interruptible basis, to be purchased and utilized by Buyer when and to the extent Seller has gas available, tenders such gas to Buyer and Buyer has a requirement for fuel. Interruptions Seller makes no guarantee of transportation service shall deliveries hereunder. Interruptible gas will be at offered when, and to the sole discretion extent, available in accordance with the operating procedures set forth in Article IV, Paragraph 4, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Interruptible Gas under this paragraph of the Service Agreement shall be transportedon adaily basisduring thecalendarmonth. utilized by Buyer hastheright to changethe volumeto betransportedduring themonthon adaily basis. It is Buyer'sresponsibilityto notify producers,Seller,andconnectingpipelines regardingany changein transportationvolumes. Deliveries of Interruptible Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority-of- Service Category 313 as set forth in Article III, Paragraph 1, of the General Terms and Conditions hereto attached. . HOURLY DELIVERIES Seller shall not be obligated to m ak,e_ourly deliveries of gas pursuant to Paragraph 1 above at an hourly rate exceedin_fdekatherms per hour. Seller reserves the right to regulate the flow of gas delivered hereunder by means of automatic or manually operated flow control valves so as to limit the hourly flow of gas within the specified quantity. . POINT OF DELIVERy The Point of Delivery for all gas delivered hereunder shall be at the sole discretion outlet side of Seller's measuring and regulating equipment. The measuring equipment shall be installed on the Buyer's property at a location mutually agreed upon by Seller and Buyer. All gas shall be delivered at this location and it shall be the Buyer's responsibility to extend all fuel lines from this location to the point or whenever service is interrupted by SCPC or any other transporting pipelinepoints of usage. , DAILY DELIVERIES . DELIVERY PRESSURE Seller agrees to accept use due care and transport diligence to furnish gas hereunder at such uniform pressure as Seller may elect up to dekatherms, excluding shrinkage volumes, of natural gas on a daily basis. Buyer will notify Seller, in writing, of Buyer's intent to transport on Seller's Form CA1, at least five (5) working days prior to the beginningof anymonth andwill provide theestimatedvolumesof gas,in dekatherms, to be transportedon adaily basisduring thecalendarmonth. Buyer hastheright to changethe volumeto betransportedduring themonthon adaily basis. It is Buyer'sresponsibilityto notify producers,Seller,andconnectingpipelines regardingany changein transportationvolumes. Sellerwill acceptchangesin daily volumesdispatchedfrom SCPC;however,Sellerreservesthe right to limit or restrict the volumesacceptedandtransportedat any time, whenever,in Seller'ssole opinion, operatingconditionswarranta limitation or restrictionon the acceptanceor delivery of transportationgas. Limitations or restrictionsmay be becauseofto, but not limited toexceeding 15 pounds per square inch gauge, and not less than 5 pounds per square inch gauge, at the utilization "Point of deliverability capacity by Seller Delivery". Buyer shall be responsible for the installation and operation of adequate safety equipment downstream of the Point of Delivery so as to relieve or control pressure variations within the limits described above that may, for any reason through malfunction of Seller's system supply requirementsequipment or otherwise, occur on Buyer's side of the "Delivery Point".

SCOPE OF DELIVERY. (A) FIRM GAS. pRIORITY-OF-SERVICE CATEGORY 3A Buyer agrees to purchase from Seller, and Seller agrees to accept deliveries sell to Buyer, up to the Maximum Daily Quantity of natural gas belonging which shall not be subject to interruption or curtailment except for conditions as set forth in Article IV, Paragraph 3, of the General Terms and Conditions hereto attached. Any gas taken by Buyer at above the Maximum Daily Quantity, after notice from Seller of curtailment to the Maximum Daily Quantity, without Seller's delivery point from SCPC located near Sumteradvance approval, South Carolinashall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 5, of the General Terms and Conditions to transport Buyer's gas and redeliver to BuyerIndustrial Service Agreements hereto attached. Deliveries of Firm Gas under this paragraph of the Service provided hereunder is in lieu of natural gas provided from Seller's system supply to satisfy Buyer's fuel requirements Agreement shall be utilized by Buyer only in Priority-of-Service Category 3D. 3A as set forth in Article III, Paragraph 1, of the General Terms and Conditions hereto attached. Buyer shall purchase all gas tendered by Seller up to the Maximum Daily Quantity whenever and to the extent Buyer has a requirement for fuel in the Priority-of-Service Category set forth herein. (B) INTERRUPTIBLE GAS. PRIORITY-OF-SERVICE CATEGORY 6 Buyer agrees that the transportation service is provided to purchase from Seller, and Seller agrees to sell to Buyer, up to a Maximum Daily Quantity of 600 dekatherms of natural gas per day on an interruptible basis, to be purchased and utilized by Buyer when and to the extent Seller has gas available, tenders such gas to Buyer and Buyer has a requirement for fuel. Interruptions Seller makes no guarantee of transportation service deliveries hereunder. Interruptible gas will be offered when, and to the extent, available in accordance with the operating procedures set forth in Article IV, Paragraph 4, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Any gas taken by Buyer, including gas utilized as fuel for pilots, after any order of Seller calling for complete curtailment of Buyer's interruptible load, or any gas taken by Buyer in excess of a partial curtailment order, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 6, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Interruptible Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority- of-Service Category 6 as set forth in Article III, Paragraph 1, of the General Terms and Conditions hereto attached. . HOURLY DELIVERIES (A) Seller shall not be obligated to make hourly deliveries of gas pursuant to Paragraph I(A) above, at an hourly rate in excess of 3.6 dekatherms per hour. Seller reserves the sole discretion right to regulate the flow of gas delivered hereunder by means of automatic or manually operated flow control valves so as to limit the hourly flow of gas within the specified quantity. (B) Seller shall not be obligated to make hourly deliveries of gas pursuant to Paragraph I(B) above at an hourly rate in excess of 25 dekatherms per hour. Seller reserves the right to regulate the flow of gas delivered hereunder by means of automatic or whenever service is interrupted by SCPC or any other transporting pipelinemanually operated flow control valves so as to limit the hourly flow of gas within the specified quantity. , DAILY DELIVERIES . Limitations or restrictionsmay be becauseofto, but not limited toexceeding 35 pounds per square inch gauge, and not less than 5 pounds per square inch gauge, at the utilization "Point of deliverability capacity by Seller Delivery". Buyer shall be responsible for the installation and operation of adequate safety equipment downstream of the Point of Delivery so as to relieve or control pressure variations within the limits described above that may, for any reason through malfunction of Seller's system supply requirementsequipment or otherwise, occur on Buyer's side of the "Delivery Point".

Service provided hereunder is in lieu of natural gas provided from Seller's system supply sources. ▇▇▇▇▇'s gas may be transported to Buyer by Seller upon execution of a Transportation Agreement between ▇▇▇▇▇ and Seller. Natural gas is provided hereunder to satisfy Buyer's requirements when Seller is not providing transportation services. ▇▇▇▇▇ agrees to purchase from Seller, and ▇▇▇▇▇▇ agrees to .sell to Buyer, up to a Maximum Daily Quantity of 250 dekatherms of natural gas per day on an interruptible basis, to be purchased and utilized by Buyer when and to the extent Seller has gas available, tenders such gas to Buyer and Buyer has a requirement for fuel. Seller makes no guarantee of deliveries hereunder. Interruptible gas will be offered when, and to the extent, available in accordance with the operating procedures set forth in Article IV, Paragraph 4, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Any gas taken by Buyer, including gas utilized as fuel requirements for pilots, after any order of Seller calling for complete curtailment of Buyer's interruptible load, or any gas taken by Buyer in excess of a partial curtailment order, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 6, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Interruptible Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority-of-Service Category 3D. 3D as set forth in Article III, Paragraph 1, of the General Terms and Conditions hereto attached. Natural gas is provided hereunder to satisfy Buyer's requirements when Seller is not providing transportation services. ▇▇▇▇▇ agrees to purchase from Seller, and ▇▇▇▇▇▇ agrees to sell to Buyer, up to a Maximum Daily Quantity of 30 d0ekatherms of natural gas per day on an interruptible basis, to be purchased and utilized by Buyer when and to the extent Seller has gas available, tenders such gas to Buyer and Buyer has a requirement for fuel. Interruptions Seller makes no guarantee of transportation service deliveries hereunder. Interruptible gas will be offered when, and to the extent, available in accordance with the operating procedures set forth in Article IV, Paragraph 4, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Any gas taken by Buyer, including gas utilized as fuel for pilots, after any order of Seller calling for complete curtailment of Buyer's interruptible load, or any gas taken by Buyer in excess of a partial curtailment order, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 6, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Deliveries of Interruptible Gas under this paragraph of the Service Agreement shall be utilized by Buyer only in Priority-of-Service Category 3F as set forth in Article III, Paragraph 1, of the General Terms and Conditions hereto attached. . HOURLY DELIVERIES (A) Seller shall not be obligated to make hourly deliveries of gas pursuant to Paragraph I(A) above at an hourly rate exceeding 9_ dekatherms per hour. Seller reserves the right to regulate the flow of gas delivered hereunder by means of automatic or manually operated flow control valves so as to limit the hourly flow of gas within the specified quantity. (B) Seller shall not be obligated to make hourly deliveries of gas pursuant to Paragraph I(B) above at an hourly rate exceeding 18 dekatherms per hour. Seller reserves the right to regulate the flow of gas delivered hereunder by means of automatic or manually operated flow control valves so as to limit the hourly flow of gas within the specified quantity. , POINT OF DELIVERY The Point of Delivery for all gas delivered hereunder shall be at the sole discretion outlet side of Seller Seller's measuring and regulating equipment. The measuring equipment shall be installed on the Buyer's property at a location mutually agreed upon by ▇▇▇▇▇▇ and Buyer. All gas shall be delivered at this location and it shall be the Buyer's responsibility to extend all fuel lines from this location to the point or whenever service is interrupted by SCPC or any other transporting pipelinepoints of usage. , DAILY DELIVERIES Seller ° DELIVERY PRESSURE (A) ▇▇▇▇▇▇ agrees to accept use due care and transport diligence to furnish gas hereunder at such uniform pressure as Seller may elect up to dekatherms, excluding shrinkage volumes, of natural gas on a daily basis. Buyer will notify Seller, in writing, of Buyer's intent to transport on Seller's Form CA1, at least five (5) working days prior to the beginningof anymonth andwill provide theestimatedvolumesof gas,in dekatherms, to be transportedon adaily basisduring thecalendarmonth. Buyer hastheright to changethe volumeto betransportedduring themonthon adaily basis. It is Buyer'sresponsibilityto notify producers,Seller,andconnectingpipelines regardingany changein transportationvolumes. Sellerwill acceptchangesin daily volumesdispatchedfrom SCPC;however,Sellerreservesthe right to limit or restrict the volumesacceptedandtransportedat any time, whenever,in Seller'ssole opinion, operatingconditionswarranta limitation or restrictionon the acceptanceor delivery of transportationgas. Limitations or restrictionsmay be becauseofto, but not limited exceeding 20 pounds per square inch gauge, and not less than 5 pounds per square inch gauge, at the "Point of Delivery". Buyer shall be responsible for the installation and operation of adequate safety equipment downstream of the Point of Delivery so as to relieve or control pressure variations within the limits described above that may, for any reason through malfunction of Seller's equipment or otherwise, occur on Buyer's side of the "Delivery Point". (B) ▇▇▇▇▇▇ agrees to use due care and diligence to furnish gas hereunder at such uniform pressure as Seller may elect up to, but not exceeding 60 pounds per square inch gauge, and not less than 20 pounds per square inch gauge, at the utilization "Point of deliverability capacity by Seller Delivery". Buyer shall be responsible for the installation and operation of adequate safety equipment downstream of the Point of Delivery so as to relieve or control pressure variations within the limits described above that may, for any reason through malfunction of Seller's system supply requirementsequipment or otherwise, occur on Buyer's side of the "Delivery Point.

SCOPE OF DELIVERY. Seller (A) FIRM GAS, PRIORITY-OF-SERVICE CATEGORY 2 ▇▇▇▇▇ agrees to accept deliveries purchase from Seller, and ▇▇▇▇▇▇ agrees to sell to Buyer, up to the Maximum Daily Quantity of natural gas belonging which shall not be subject to interruption or curtaihnent except for conditions as set forth in Article IV, Paragraph 3, of the General Terms and Conditions hereto attached. The Maximum Daily Quantity of Firm Gas shall be 100 dekatherms per day. Any gas taken by Buyer at above the Maximum Daily Quantity, after notice from Seller of curtaihnent to the Maximum Daily Quantity, without Seller's delivery point from SCPC located near Sumteradvance approval, South Carolinashall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 5, of the General Terms and Conditions to transport Buyer's gas and redeliver to BuyerIndustrial Service Agreements hereto attached. Deliv• eries of Firm Gas under this paragraph of the Service provided hereunder is in lieu of natural gas provided from Seller's system supply to satisfy Buyer's fuel requirements Agreement shall be utilized by Buyer only in Priority-of-Service Category 3D. 2. as set forth in Article III, Paragraph 1, of the General Terms and Conditions hereto attached. Buyer shall purchase all gas tendered by Seller up to the Maximum Daily Quantity whenever INTERRUPTIBLE GAS, PRIORITY-OF-SERVICE CATEGORY 3C ▇▇▇▇▇ agrees that the transportation service is provided to purchase from Seller, and ▇▇▇▇▇▇ agrees to sell to Buyer, up to a Maximum Daily Quantity of 150 dekatherms of natural gas per day on an interruptible basis, to be purchased and utilized by Buyer when and to the extent Seller has gas available, tenders such gas to Buyer and Buyer has a requirement for fuel. Interruptions Seller makes no guarantee of transportation service shall deliveries hereunder. Interruptible gas will be at offered when, and to the sole discretion extent, available in accordance with the operating procedures set forth in Article IV, Paragraph 4, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Limitations or restrictionsmay be becauseof, but not limited to, the utilization of deliverability capacity by Seller for Seller's system supply requirementsGeneral Terms and Conditions hereto attached.

SCOPE OF DELIVERY. Seller agrees to accept deliveries of natural gas belonging to Buyer at any of Seller's delivery point points from SCPC located near Sumter, South Carolina, Transco or Southern and to transport Buyer's gas and redeliver to BuyerLDC at Effingham, South Carolina. Service provided hereunder is in lieu of natural gas provided from Seller's system supply to satisfy Buyer's fuel requirements in Priority-of-Service Category 3D. Buyer agrees that the transportation service is provided on an interruptible basis. Interruptions of transportation service shall be at the sole discretion of Seller or whenever service is interrupted by SCPC an interstate supplier. Seller is expected to exercise the ordinary and reasonable standards of the gas industry in regard to interruptions. Buyer hereby certifies that Buyer and LDC have entered into a Transportation Agreement whereby LDC will accept Buyer's gas from Seller. Buyer hereby agrees to make copies of this Interruptible Transportation Agreement available to Seller upon Seller's request. Buyer agrees to notify Seller of any and all amendments, modifications, changes, cancellations, or extensions of any other transporting pipelinekind whatsoever of the Transportation Agreement between Buyer and LDC. , DAILY DELIVERIES Seller agrees to accept and transport up to 925 dekatherms, excluding shrinkage volumes, of natural gas on a daily basis. Buyer will shall notify Seller, in writing, Seller of Buyer's intent to transport on Seller's Form CA1, at least five (5) working days prior to the beginningof anymonth andwill beginning of any month and will provide theestimatedvolumesof gas,the estimated volumes of gas in dekatherms, dekatherms to be transportedon adaily basisduring thecalendarmonthtransported on a daily basis during the next calendar month. Buyer hastheright has the fight to changethe volumeto betransportedduring themonthon adaily change the volume to be transported during the month on a daily basis. It is Buyer'sresponsibilityto Buyer's responsibility to notify producers,, Seller,andconnectingpipelines regardingany changein transportationvolumes, and connecting pipelines regarding any change in transportation volumes. Sellerwill acceptchangesin Seller will accept changes in daily volumesdispatchedfrom SCPC;however,Sellerreservesthe right volumes dispatched from either Southern or Transco; however, Seller reserves the fight to limit or restrict the volumesacceptedandtransportedat volumes accepted and transported at any time, whenever,, in Seller'ssole Seller's sole opinion, operatingconditionswarranta operating conditions warrant a limitation or restrictionon restriction on the acceptanceor acceptance or delivery of transportationgastransportation gas. Limitations or restrictionsmay restrictions may be becauseofbecause of, but not limited to, the utilization of deliverability capacity by Seller for Seller's system supply requirements.

SCOPE OF DELIVERY. (A) INTERRUPTIBLE GAS, PRIORITY-OF-SERVICE CATEGORY 3D Seller agrees to accept deliveries acknowledges that Buyer may utilize a source of natural gas belonging to Buyer at Seller's delivery point from SCPC located near Sumter, South Carolina, and to transport Buyer's other than system supply gas and redeliver to Buyer. Service provided hereunder is in lieu of natural gas provided from Seller's system supply sources. ▇▇▇▇▇'s gas may be transported to Buyer by Seller upon execution of a Transportation Agreement between ▇▇▇▇▇ and Seller. Natural gas is provided hereunder to satisfy Buyer's requirements when Seller is not providing transportation services. ▇▇▇▇▇ agrees to purchase from Seller, and ▇▇▇▇▇▇ agrees to sell to Buyer, up to a Maximum Daily Quantity of 1040 dekatherms of natural gas per day on an interruptible basis, to be purchased and utilized by ▇▇▇▇▇ when and to the extent Seller has gas available, tenders such gas to Buyer and Buyer has a requirement for fuel. Seller makes no guarantee of deliveries hereunder. Interruptible gas will be offered when, and to the extent, available in accordance with the operating procedures set forth in Article IV, Paragraph 4, of the General Terms and Conditions to Industrial Service Agreements hereto attached. Any gas taken by Buyer, including gas utilized as fuel requirements for pilots, after any order of Seller calling for complete curtailment of Buyer's interruptible load, or any gas taken by Buyer in excess of a partial curtailment order, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 6, of the General Terms and Conditions to Industrial Service Agreements hereto attached. (B) Seller shall not be obligated to make hourly deliveries of gas pursuant to Paragraph I(B) above at an hourly rate exceeding 100 dekatherms per hour. Seller reserves the right to regulate the flow of gas delivered hereunder by means of automatic or restrict manually operated flow control valves so as to limit the volumesacceptedandtransportedat any time, whenever,in Seller'ssole opinion, operatingconditionswarranta limitation or restrictionon hourly flow of gas within the acceptanceor delivery of transportationgas. Limitations or restrictionsmay be becauseof, but not limited to, the utilization of deliverability capacity by Seller for Seller's system supply requirementsspecified quantity.
