Use of Equipment Clause Samples

Use of Equipment. The Association shall have the right to use school facilities and equipment including typewriters, duplicating equipment, calculating machines, and all types of audio visual, equipment, at reasonable times when such equipment is not otherwise in use, for the purpose of coordinating Association business. The local Association shall pay for the reasonable cost of all materials and supplies incident to use.

Use of Equipment. The Federation shall have the right to use equipment when such equipment is not otherwise in use for normal operational purposes. Such use shall require the authorization of the appropriate administrator and shall result in no additional cost to the Employer.

Use of Equipment. The equipment, spares and consumables imported for petroleum operations under this Contract shall not be used or deployed by the Contractor for any purpose other than the performance of the Work. In the event that the equipment, spares or consumables are used or deployed for any purpose other than the performance of the Work, the Contractor shall be liable for all additional duty, fines or penalties imposed or other actions taken by the customs department or any relevant authority.

Use of Equipment. Lessee shall only use the Equipment in a careful and proper manner and will comply with all laws, rules, ordinances, statutes and orders regarding the use, maintenance of storage of the Equipment.

Use of Equipment mechanical failure of the equipment; negligent design or manufacture of the equipment; the provision of or the failure by the Organization to provide any warnings, directions, instructions or guidance as to the use of the equipment; failure to use or operate the equipment within my own ability.

Use of Equipment. The primary use of the Equipment by the Student is for the Student’s educational programs. The Student may use the Equipment for other purposes only to the extent that such uses do not interfere with the primary uses. The Student shall abide by the School’s Acceptable Use Policies (AUP). Violation of the School’s AUP, which requires administrative correction/repair by the School’s Technology Department, will incur a minimum fee.

Use of Equipment. Customer shall operate the equipment according to the manufacturer’s specifications and documented instructions. Customer agrees not to employ or use additional attachments, features or devices on the equipment or make changes or alterations to the equipment covered hereby without the prior written consent of Vendor in each case, which consent shall not be unreasonably withheld.

Use of Equipment. Ownership of the Equipment shall remain with LocalTel Communications. You may use the Equipment solely at the location noted on the other side of this Agreement under “Service Address” and shall not remove, lease, sublease, rent, lend, sub-rent, transfer, assign, sell, alter, repair, disassemble, modify, encumber or assign a security interest in Equipment without our prior written consent. You shall use Equipment in a careful and proper manner as instructed by LocalTel or the manufacturer. You may not use Equipment for any illegal purpose or in an illegal manner. You will, at your expense, comply with all applicable laws and regulations pertaining to the use, operation and transportation of Equipment and will defend, indemnify and hold us harmless for any loss, liability, or expense resulting from actual or alleged violations of such laws or regulations. During the term of your Service, unless you purchase any or all of the Equipment, we shall provide repairs on Equipment which becomes defective through no fault of Subscriber. In the event of any Equipment failure, Subscriber shall contact LocalTel Communications immediately for servicing. Under no circumstances will LocalTel Communications provide reimbursements for repairs, parts, or supplies provided by others unless specifically authorized in writing by us. If at the time of repair it is determined that the Equipment was damaged by something other than normal Equipment failure & wear and tear, Subscriber will be liable for the cost of replacement Equipment or repair, whichever is less determined by LocalTel Communications. DELIVERY, ACCEPTANCE & RETURN: Subscriber hereby acknowledges receipt of the Equipment and that it is in good working order and repair. Upon termination of this Agreement, unless Subscriber has previously purchased the wireless Equipment, Subscriber shall return all Equipment, including all cables, adapters & mounting hardware, in substantially the same good working order and repair to LocalTel Communications. Use of Equipment. City shall not be liable for any damage to persons or property as a result of the use, misuse or failure of any equipment used by Contractor, or any of its subcontractors, or by any of their employees, even though such equipment is furnished, rented or loaned by City.
