Secondary Assignments Clause Samples

The Secondary Assignments clause governs the conditions under which rights or obligations under an agreement may be transferred to a third party after the initial assignment. Typically, this clause outlines whether such secondary transfers require the consent of the original parties or are subject to specific limitations, such as restrictions on assigning to competitors or entities lacking sufficient financial standing. Its core practical function is to maintain control and oversight over subsequent transfers, thereby preventing unwanted or potentially harmful parties from acquiring interests in the agreement.

Subject matter preparations and teaching periods for special education teachers will be established by the principal after consultation with teachers and consideration of students and teacher needs.

As such, they should be assigned in a fair manner. The parties acknowledge that the Department retains its authority to structure the operations of the Department as it sees fit; the provisions of this Agreement only address how employees are chosen to fill bargaining unit opportunities within that structure and its parts. When the Department fills vacancies in any such Secondary Assignments, the process will be the same as set forth above for filling full-time job assignments. The parties recognize that the Department has the authority to require officers on certain shifts to fill these duties and assignments; within those needs, the process set forth above will be followed.
