Common use of Section 2.1 Clause in Contracts

Section 2.1. 11 It is agreed that the customary and usual rights, powers, functions and authority of management are 12 vested in management officials of the District. Included in these rights in accordance with and subject 13 to applicable laws, regulations, and the provisions of this Agreement, unless clearly relinquished, is the 14 right to direct the work force, the right to hire, promote, retain, transfer, and assign employees in 15 positions; the right to suspend, discharge, demote, or take other disciplinary action against employees;

The District shall retain the right to maintain efficiency of the District operation by 21 determining the methods, the means, and the personnel by which such operation is conducted.

Section 2.1. 11 37 It is agreed that the customary and usual rights, powers, functions functions, and authority of management are 12 38 vested in management officials of the District. Included in these rights in accordance with and subject 13 39 to applicable laws, regulations, and the provisions of this Agreement, unless clearly relinquishedagreement, is the 14 right to direct the work 40 force, the right to hire, promote, retain, transfer, and assign employees in 15 positions; the right to 41 suspend, discharge, demote, or take other disciplinary action against employees;; and the right to 42 release employees from duties because of lack of work or for other legitimate reasons. Included in these rights in accordance with applicable 20 laws and subject 13 to applicable laws, regulations, and the provisions of this Agreement, unless clearly relinquished, regulations is the 14 right to direct the work force, to adjust the starting and quitting times, the 21 right to hire, promote, retain, transfer, and assign employees in 15 positions; the right to suspend, 22 discharge, demote, or take other disciplinary action against employees;; and the right to release 24 retain the right to maintain efficiency of the District operation by determining the methods, the means, 25 and the personnel by which such operation is conducted.
