Common use of Section 3.4 Clause in Contracts

Section 3.4. 14 Neither the District, nor the Association, shall discriminate against any employee subject to this 15 Agreement on the basis of race, color, religion, creed, gender, age, national origin, marital status, 16 sexual orientation including gender expression or identity, veteran status, or physical, mental, or 17 sensory disability, the use of a trained guide dog or service animal by a person with a disability, or 18 honorably-discharged veteran or military status or any other basis prohibited by law, the duties of 19 which may be performed efficiently by an individual without danger to the health or safety of the 20 physically disabled person or others.

Section 3.4. 14 11 Neither the District, nor the Association, shall discriminate against any employee subject to this 15 12 Agreement on the basis of race, creed, color, sex, religion, creed, gender, age, national origin, marital status, 16 sexual orientation including gender expression or identityhonorably discharged 13 veteran, veteran military status, or physicalsexual orientation, the presence of any sensory, mental, or 17 sensory disability, physical disability 14 or the use of a trained dog guide dog or service animal by a the person with a disability, or 18 honorably-discharged veteran or military status or any other basis prohibited by lawdisability that is recognized as 15 and declared to be a civil right, the duties of 19 which may be performed efficiently by an individual 16 without danger to the health or safety of the 20 physically disabled handicapped person or others.
