Section 9.6.4 Clause Samples

Section 9.6.4. Employees hired to fill positions of employees on leave of absence will be hired for a specific 6 period of time, during which they shall be subject to all provisions of this Agreement. It shall 7 be the responsibility of the employer to inform replacement employees of these provisions.

Section 9.6.4. Decreases of one (1) hour or more to a job assignment during any school year shall allow the 6 affected employee to bump a less senior employee in an equivalent position within their 7 classification. Within five (5) working days following notification of reduction, said employee 8 must submit a written request to bump. Exception: See Section 9.11. Bumping into an 9 equivalent position triggers the twenty (20) day right to return language (Section 9.9). The 10 affected employee may not bump into intervention specialist positions, special education child 11 specific positions nor special education self-contained classroom positions even if they are 12 more senior than the employee(s) in those positions.

Section 9.6.4. 30 Displaced employees who are interviewed for possible placement shall be notified of the results 31 of such interviews as soon as practicable after interviewing for the vacant position.

Section 9.6.4. 11 Family leave will be granted in accordance with the Federal Family Leave Act of 1993. 15 A R T I C L E X 16 17 PROBATION, SENIORITY AND LAYOFF PROCEDURES 19 Section 10.1. 20 The seniority of an employee within the bargaining unit shall be established as of the date on which the 21 employee began continuous daily employment (hereinafter "hire date") unless such seniority shall be 22 lost as hereinafter provided.

Section 9.6.4. 14 If employees accept other employment while on leave of absence, they must get the prior 15 approval of the District or forfeit all re-employment rights.

Section 9.6.4. 30 Employees who enlist, or have enlisted, in the Armed Forces of the United States shall be 31 granted an extended leave of absence for a length of time sufficient to cover their initial term of 32 active duty.

Section 9.6.4. 11 The District shall have the exclusive option of posting a vacancy on a temporary basis. If the 12 vacancy is posted temporarily, the employee on leave shall be returned to the position at the 13 end of the leave. 15 If a permanent employee bids on and fills a posted temporary vacancy, he/she shall be subject 16 to return as provided in 9.6.3.
