Section 9.7. 40 The employee with the greatest seniority in classification shall have preferential rights regarding 41 vacation periods, promotions, assignment to new or open jobs or positions, and layoffs when ability 42 and performance are substantially equal with junior employees. 44 If the District determines that seniority rights should not govern because a senior employee does not 45 meet the minimum requirements, or does not possess the specific skills or required experience related 46 to the job description and/or posting, the District shall set forth in writing to the employee or 1 employees and the Association President or their designee, its reasons why the senior employee or 2 employees have been bypassed.
