Seniority Principle. (a) The Parties recognize that job opportunity and seniority should increase in proportion to length of service. It is agreed that the term "seniority" as used herein, shall have reference to an employee's continuous length of service with the Company. The employee's right to a job shall be based on seniority, skill and ability. Ability to do a job will mean the ability to meet the requirements of a job as set forth in the job posting. (b) All promotions, transfers, filling of vacancies, layoffs, terminations, will be done strictly in accordance with the principles set forth in 8.01 (a), except as provided in 8.01 (c). (c) Promotions or transfers to higher paid jobs or better jobs with equal pay shall be based on an employee's ability, qualifications and seniority. Among employees meeting the requirements of a job as set forth in the job posting, seniority shall be the governing factor. (d) Seniority of each employee covered by this Agreement shall be established after a probationary period of thirty (30) calendar days. Seniority when established shall count from the date of employment.
