Common use of Seniority Principle Clause in Contracts

Seniority Principle. (a) The Parties recognize that job opportunity and seniority should increase in proportion to length of service. It is agreed that the term "seniority" as used herein, shall have reference to an employee's right to a job based upon his length of service with the Company and his ability to efficiently fulfil the job requirement. (b) All promotions, transfers, filling of vacancies, and permanent or temporary lay- offs will be done strictly in accordance with the principles set forth in 8.01(a).

It is agreed that the term "seniority" as used herein, shall have reference to an employee's right to a job based upon his his/her length of service with the Company Company, and his his/her ability to efficiently fulfil the job requirementrequirements, after a minimum trial period of not less than five (5) days and not more than forty-five (45) days worked in which the employee has demonstrated that he/she has the ability to perform the work available. (b) All promotions, transfers, filling of vacancies, and permanent or temporary lay- offs will be done strictly in accordance with the principles set forth in 8.01(a).
