Separate Mining Program. After completion of a Feasibility Study, if the Manager does not propose a Mining Program for the relevant Production Area upon the expiration of the current Program, or if the Manager proposes a Mining Program but it is not adopted in the first vote by the Management Committee on such proposal, then the non-managing Participant may propose a Mining Program for the relevant Production Area, to be considered by the Participants in accordance with the procedures set forth in Section 9.5(a). If that Mining Program is not adopted by the Management Committee, then the non-managing Participant may elect by written notice to the Management Committee to conduct its Mining Program as a Separate Mining Program. The other Participants (including the Manager) shall then elect whether to contribute to the Separate Mining Program in accordance with the procedure set forth in Section 9.6, and their respective Participating Interests in the relevant Production Area shall be calculated in accordance with Section 6.3.
Separate Mining Program. After completion of a Favourable Feasibility Study and within one hundred and eighty (180) days prior to the expiration of a Development Program, any Non-Operator may request that the Operator propose in the next Program and Budget the opening of a mine. If the Operator does then propose the opening of the mine, the proposal will be considered according to Subsections 11.4(a), (b), and (c). If the Operator does not then propose the opening of a mine, the Non-Operator may propose, under Subsection 11.4(b), a Mining Program that includes the opening of a mine. If that proposed Mining Program is not adopted by the Management Committee within thirty (30) days of a submittal, the Non-Operator may conduct that Program as Operator. To do so, such Non-Operator shall, within ten (10) days after expiration of the thirty (30) days, give written notice to the Operator of its intent to conduct its proposed Mining Program as a Separate Mining Program under this Subsection 11.4(e) as Operator for the Program. The other Party shall then elect, according to Section 11.5, whether to participate in the Separate Mining Program.

  • First Source Hiring Program Contractor must comply with all of the provisions of the First Source Hiring Program, Chapter 83 of the San Francisco Administrative Code, that apply to this Agreement, and Contractor is subject to the enforcement and penalty provisions in Chapter 83.

  • Training Program It is agreed that there shall be an Apprenticeship Training Program, the provisions of which are set forth in Exhibit "D", which is attached hereto and forms part of this Agreement.

  • Educational Program A. DSST PUBLIC SCHOOLS shall implement and maintain the following characteristics of its educational program in addition to those identified in the Network Contract at DSST ▇▇▇▇ MIDDLE SCHOOL (“the School” within Exhibit A-3).
