FURTHER, DEMAND PARTNER ACKNOWLEDGES THAT AD INVENTORY IS PROVIDED BY SUPPLY PARTNERS AND THAT FYBER DOES NOT ENDORSE NOR MAKE ANY REPRESENTATION OR WARRANTY REGARDING THE ACCURACY, TRUTH, QUALITY, SUITABILITY OR RELIABILITY OF ANY PROMISE, CLAIM OR STATEMENT CONTAINED IN ANY AD INVENTORY. FYBER IS NOT RESPONSIBLE FOR ANY ERRORS, OMISSIONS, OR INACCURACIES CONTAINED IN ANY AD INVENTORY. DEMAND PARTNER ACKNOWLEDGES THAT IT HAS RECEIVED NO ASSURANCES FROM FYBER THAT IT WILL EARN ANY PARTICULAR AMOUNT OF MONEY BY USING THE SERVICE OR THAT IT WILL RECOUP ANY EXPENDITURE MADE IN FULFILLMENT OF ITS OBLIGATIONS UNDER THIS AGREEMENT. FYBER IS UNDER NO OBLIGATION TO MONITOR SUPPLY PARTNERS COMPLIANCE, AND DEMAND PARTNER SHALL HAVE NO CLAIM AGAINST FYBER FOR ANY SUPPLY PARTNER’S BREACH OF, ANY TERMS AND CONDITIONS OR ANTI- FRAUD RULES APPLICABLE TO A SUPPLY PARTNER. FYBER MAKES NO WARRANTY AND/OR ASSURANCES IN RESPECT OF USERS' RESPONSE TO THE ADS.
Service Disclaimer. There may be service disruptions or events beyond our control that could adversely affect the Card Control Service. Such disruptions or events, include, but are not limited to: telecommunication system delays or outages; power outages; network, communication or data plan outages; natural disasters; or any other event outside the control of us. Any such disruption or event may block or otherwise limit your usage of the Card Control Service and/or use of your Debit Card based off of the card settings in place at the time of the disruptions. You agree that we will not be liable for any losses or damages as a result of Service unavailability. You must always examine your Account statements promptly and routinely review all transactions and other activity on your Account.

TMMN is not responsible for certain conditions or equipment that may affect the Service, including, without limitation: • Failure or poor performance of Customer’s Domain Name Server (“DNS Server”) and/or local area network (“LAN”) upon which the Service relies. Network-related outages also may occur, and service restoration intervals may vary from those associated with traditional telecommunications service. • Failure or poor performance of Customer’s Internet access service and/or routers, switches, or other Customer equipment, with effects including but not limited to loss of circuit connectivity, high jitter, latency, or packet loss. • Communications from analog modems may have protocol interaction issues when used over Service technology (due to their handshake and error-checking rules) and cannot be assured to be of the same quality as other communications. • All inside wiring and special construction at each of Customer’s sites.

Further, Demand Partner acknowledges that Ad Inventory is provided by Supply Partners and that Fyber does not endorse nor make any representation or warranty regarding the accuracy, truth, quality, availability, suitability or reliability of any promise, claim or statement contained in any Ad Inventory and/or Bid Request (as applicable) or App that is available via the Service. Fyber is not responsible for any errors, omissions, or inaccuracies contained in any Ad Inventory and/or Bid Request (as applicable) or in any App that is offering such Ad Inventory for sale. Demand Partner acknowledges that it has received no assurances from Fyber that it will receive or earn any particular value or amount of money by using the Service or that it will recoup any expenditure made in fulfillment of its obligations under this Agreement. Fyber is under no obligation to monitor Supply Partners compliance, and Demand Partner shall have no claim against Fyber for any Supply Partner’s breach of, any terms and conditions or anti-fraud rules applicable to a Supply Partner. Fyber makes no warranty and/or assurances in respect of Users' response to the Ads. Fyber does not provides any warranty or guarantee that Ads will be displayed in a quantity, manner or reach performance satisfactory to Demand Partner.
