SERVICE USER HEALTH RECORDS. 1. The Provider must create, maintain, store and retain Service User health records for all Service Users. The Provider must retain Service User health records for the periods of time required by Law and thereafter shall notify the Authority that such period of time for retention has expired and seek the Authority’s instruction as to what should be done with such Service User health records (which may include, without limitation, providing such Service User health records to the Authority or securely destroying them in accordance with any applicable Guidance). B13.2. The Provider must: a) use Service User health records solely for the execution of the Provider’s obligations under this Contract; b) give each Service User full and accurate information regarding his/her treatment and Services received; and c) provide copies of the such Service User health records to the Authority as Authority data on expiry or early termination of this Contract as part of the Succession Plan, or otherwise following written request from the Authority. B13.3. The Provider must at all times during the term of this Contract have a Caldicott Guardian and shall notify the Authority of their identity and contact details prior to the Service Commencement Date. If the Provider replaces its Caldicott Guardian at any time during the term of this Contract, it shall promptly notify the Authority of the identity and contact details of such replacements. B13.4. Subject to Guidance and where appropriate, the Service User health records should include the Service User’s verified NHS number.
