Common use of SERVICE WITH PREDECESSOR EMPLOYER Clause in Contracts

SERVICE WITH PREDECESSOR EMPLOYER. If so designated by the Employer in the Adoption Agreement, an Employee's Years of Service for eligibility purposes shall include all years of service (determined in a manner consistent with subsection (a) above) with any predecessor employer of the Employer; provided, however, that if the Employer is maintaining the Plan as the plan of a predecessor employer, an Employee's Years of Service shall automatically include years of service with such predecessor employer without regard to any designation in the Adoption Agreement.
