SERVICES AND RESPONSIBILITIES. 3.1.1 Standard of Care: Design Builder shall perform or furnish Design Professional Services and related services in all phases of the project. The standard of care for all such services performed or furnished under this Agreement will be the care and skill ordinarily used by members of the engineering profession practicing under similar conditions at the same time and locality. 3.1.2 The Design Builder shall be responsible to the Owner for acts and omissions of the Design Builder’s employees, subcontractors and their agents and employees, and other persons, including other design professionals, performing any portion of the Design Builder’s obligations under this Agreement.
