Services Availability. 3.2.1 Excluding scheduled downtime, the Services will be available to Authorised Users for not less than 98% of the time each calendar year of the Term (Uptime Percentage). 3.2.2 If downtime (as detailed below) exceeds the specified percentage (Uptime Percentage) 5 (five) times within a contract period (a Service Level Default) the Customer may pursue the option of immediate contract termination.
