Setting Out of the Works Clause Samples

The 'Setting Out of the Works' clause defines the process and responsibilities for establishing the precise location, alignment, and levels of construction works on site. Typically, this clause assigns the contractor the duty to accurately mark out the works according to the drawings and specifications provided by the employer or engineer, often requiring the use of benchmarks or reference points. Setting Out of the Works. The Contractor shall be responsible for the true and proper setting out of the Works and the correctness of the position levels, dimensions and alignment of all parts of the Works and for the provision of all necessary instrument appliances and labour in connection therewith. If at any time during the progress of the works, any error shall appear or arise in the position, levels, dimensions or alignment of any part of the Works, the Contractor on being required so to do by the Engineer or Engineers representative shall at his own expense rectify such error to the satisfaction of the Engineer or Engineer's representative unless such error is based on incorrect data supplied in writing by the Engineer or the Engineer's representative in which case the expense of rectifying the same shall be borne by the Employer. The checking of any setting out or of any line or level by the Engineer or the Engineer's representative shall not in any way relieve the Contractor of his responsibility for the correctness thereof and the Contractor shall carefully protect and preserve all bench marks, site rails, pegs and other things used in setting out the works.
Setting Out of the Works. (a) The Concessionaire shall make the setting out of the EPC Works and Road Works, including establishment of all survey reference points, benchmarks, and control objects.
Setting Out of the Works. The selling out of the work shall be the sole responsibility of the Contractor and shall be done in accordance with the "Guidelines for the provision of Engineering Services in Residential Townships" by The Department of Community Development.

  • Cost of the Work The sum of all allowable costs necessarily incurred and paid by Contractor in the proper performance of the Work.

  • Working Out of Class Section 1 Whenever an employee is requested to perform the tasks of a higher graded position, that employee shall receive the rate of pay of that higher graded position, or five percent (5%) above his/her regular rate of pay, if the rate of pay for the higher graded position is less than five percent (5%) over and above that employee's regular rate of pay and his/her regular position, whichever is greater, for each and every hour worked in any higher grade during that contract year. Section 2 An employee temporarily assigned to a lower graded position shall be compensated at the rate of pay received in his/her regularly assigned job grade.

  • Working Out of Classification Whenever an employee is assigned the principal duties and responsibilities of an employee in a higher classification for a single shift or greater period of time, that employee shall be paid a minimum of three (3) steps above their present salary, or shall receive the salary at the bottom of the range for the classification which they are working in, whichever is greater, for all such time worked.

  • CONTRACTING OUT The Employer agrees not to contract out any work presently performed by employees covered by this Agreement which would result in the laying off of such employees.

  • Opting Out 6.1 The Opt-Out Deadline has Expired (1) The deadline to opt-out of the Proceedings expired on October 24, 2018, pursuant to Orders of the Ontario, BC and Québec Courts.
