SHOP DRAWINGS, PRODUCT DATA AND SAMPLES. A. The Contractor shall furnish to the Designer all Samples of the materials to be used in the execution of the Work as required by the Contract Documents. The Contractor shall furnish to the Designer in a timely manner all coordination Drawings, shop details, Shop Drawings, and setting diagrams which may be necessary for acquiring and installing materials. These shall be reviewed as required by the Designer. Unless otherwise specified by the Awarding Authority, the Contractor shall provide a minimum of four (4) copies when submitting for final approval by the Designer, one of which shall be returned to the Contractor, one to the Resident Engineer, one to the Awarding Authority and one filed with the Designer. The Contractor shall review, approve, and submit to the Designer, Shop Drawings, Product Data, Samples and similar submittals required by the Contract Documents with reasonable promptness and in such sequence as to cause no delay in the Work or in the activities of the Awarding Authority or of separate contractors. Submittals made by the Contractor which are not required by the Contract Documents or which do not comply with the Contract Documents may be returned without action. The Contractor's attention is directed to the provisions of Section 4 of this Article V and to the Specifications. D. The Contractor shall prepare and keep current for the Designer's approval a schedule of submittals which is coordinated with the Progress Schedule and allows the Designer reasonable time to review submittals. The Contractor shall perform no portion of the Work requiring submittal and review of Shop Drawings, Product Data, Samples or similar submittals until the respective submittal has been approved by the Designer. Such Work shall be in accordance with approved submittals. F. By submitting Shop Drawings, Product Data, Samples and similar submittals, the Contractor represents that the Contractor has determined and verified materials, field measurements, and field construction criteria related thereto and has checked and coordinated the information contained within such submittals with the requirements of the Work and of the Contract Documents. G. The Contractor shall not be relieved of responsibility for deviations from requirements of the Contract Documents by the Designer's approval of Shop Drawings, Product Data, Samples or similar submittals unless the Contractor has specifically informed the Designer in writing of such deviation at the time of submittal and the Awarding Authority has given explicit written approval to the specific deviation. The Contractor shall not be relieved of responsibility for errors or omissions in Shop Drawings, Product Data, Samples, or similar submittals by the Designer's or the Awarding Authority's actions. H. The Contractor shall direct specific attention, in writing or on resubmitted Shop Drawings, Product Data, Samples or similar submittals, to revisions other than those requested by the Designer on previous submittals. I. Informational submittals upon which the Designer is not expected to take responsive action may be so identified in the Contract Documents. J. When professional certification of performance criteria of materials, systems or equipment is required by the Contract Documents, such certification must be stamped by a registered Massachusetts professional in the discipline required. The Designer shall be entitled to rely upon the accuracy and completeness of such calculations and certifications. K. Materials furnished or used or employed under the Contract must be equal in quality to the Samples furnished and be satisfactory to the Designer.

The 3.16.1 Shop Drawings are drawings, diagrams, schedules and other data specifically prepared for the Work by the Contractor shall furnish or a Subcontractor, sub- subcontractor, manufacturer, supplier or distributor to the Designer all Samples illustrate some portion of the materials to be used in the execution of Work. 3.16.2 Product Data are illustrations, standard schedules, performance charts, instructions, 3.16.3 Samples are physical samples which illustrate materials, equipment or workmanship and establish standards by which the Work as required by the Contract Documents. The Contractor shall furnish to the Designer in a timely manner all coordination Drawings, shop details, Shop Drawings, and setting diagrams which may will be necessary for acquiring and installing materials. C. 3.16.5 The Contractor shall review, approve, schedule submittal of Shop Drawings and submit Product Data to the DesignerEngineer so that no delays will result in delivery of materials and equipment, advising the Engineer of priority for checking of Shop Drawings, Drawings and Product Data, but a minimum of two weeks shall be provided for this purpose. All Shop Drawings and Product Data shall be submitted prior to the Contractor’s third partial payment request. After the second payment has been made, no further payments will be made until all required Shop Drawings and Product Data have been submitted. If Shop Drawings and Product Data are not approved by the fourth progress payment request, the Owner may withhold further payments. 3.16.6 The Contractor, at its own expense, shall submit Samples and similar submittals required by the Contract Documents with reasonable promptness and in such sequence as to cause no delay in the Work or in the activities of separate contractors and no later than twenty (20) days before materials are required to be ordered for scheduled delivery to the Awarding Authority Work site. Samples shall be labeled to designate material or products represented, grade, place of separate contractorsorigin, name of producer, name of Contractor and the name and number of the Owner’s Project. Submittals made by Quantities of Samples shall be twice the Contractor which are not number required by for testing so that Engineer can return one set of the Contract Documents or which do not comply with the Contract Documents Samples. Materials delivered before receipt of Engineer’s approval may be returned without actionrejected by Engineer and in such event, Contractor shall immediately remove all such materials from the Work site. Such Work shall be in accordance with approved submittals. F. 3.16.8 By approving and submitting Shop Drawings, Product Data, Samples and similar submittals, the Contractor represents such Submittals strictly comply with the requirements of the Contract Documents and that the Contractor has determined and verified materials, field measurements, measurements and field construction criteria related thereto thereto, that materials are fit for their intended use and has checked that the fabrication, shipping, handling, storage, assembly and coordinated installation of all materials, systems and equipment are in accordance with best practices in the information contained within such submittals industry and are in strict compliance with the any applicable requirements of the Work and of the Contract Documents. Contractor shall also coordinate each Submittal with other Submittals. G. 3.16.9 Contractor shall be responsible for the correctness and accuracy of the dimensions, measurements and other information contained in the Submittals. 3.16.10 Each Submittal will bear a stamp or specific indication that the Submittal complies with the Contract Documents and Contractor has satisfied its obligations under the Contract Documents with respect to Contractor’s review and approval of that Submittal. Each Submittal shall bear the signature of the representative of Contractor who approved the Submittal, together with the Contractor’s name, Owner’s name, number of the Project, and the item name and specification section number. 3.16.11 The Contractor shall not be relieved of responsibility for deviations from requirements of the Contract Documents by the Designer's Engineer’s approval of Shop Drawings, Product Data, Samples or similar submittals unless the Contractor has specifically informed the Designer in writing of such deviation at the time of submittal and the Awarding Authority has given explicit written approval to the specific deviationsubmittals. SHOP DRAWINGS, PRODUCT DATA AND SAMPLES. A. The Contractor shall furnish to the Designer all Samples samples of the materials to be used in the execution of the Work as required by the Contract Documents. The Contractor shall furnish to the Designer in a timely manner all coordination Drawings, shop details, Shop Drawings, and setting diagrams which may be necessary for acquiring and installing materials. These shall be reviewed as required by the Designer. Unless otherwise specified by the Awarding Authority, the Contractor shall provide a A minimum of four (4) copies when submitting shall be submitted for final approval by the Designerapproval, one of which shall be returned to the Contractor, one to the Resident Engineer, one to the Awarding Authority and one filed with the Designer. The inspection and approval by the Designer of Shop Drawings and setting diagrams Drawings, etc. shall be general and shall in no way relieve the Contractor from responsibility for proper fitting, coordinating, construction, and construction sequencing. The Contractor shall furnish to the Designer such information and vouchers relative to the Work, the materials therefor, and the persons employed thereon, as the Designer shall from time to time request. B. Shop Drawings, Product Data, Samples, and similar submittals are not Contract Documents. The purpose of their submission is to demonstrate for those portions of the Work for which submittals are required the way the Contractor proposes to conform to the information given and the design concept expressed in the Contract Documents. C. The Contractor shall review, approve, and submit to the Designer, Shop Drawings, Product Data, Samples and similar submittals required by the Contract Documents with reasonable promptness and in such sequence as to cause no delay in the Work or in the activities of the Awarding Authority or of separate contractors. Submittals made by the Contractor which are not required by the Contract Documents or which do not comply with the Contract Documents may be returned without action. The Contractor's attention is directed to the provisions of Section 4 of this Article V and to the Specifications. D. The Contractor shall prepare and keep current for the Designer's approval a schedule of submittals which is coordinated with the Progress Schedule and allows the Designer reasonable time to review submittals. E. The Contractor shall perform no portion of the Work requiring submittal and review of Shop Drawings, Product Data, Samples or similar submittals until the respective submittal has been approved by the Designer. Such Work shall be in accordance with approved Approved submittals. F. By submitting Shop Drawings, Product Data, Samples and similar submittals, the Contractor represents that the Contractor has determined and verified materials, field measurements, and field construction criteria related thereto and has checked and coordinated the information contained within such submittals with the requirements of the Work and of the Contract Documents. G.
