Common use of Space Preferences Clause in Contracts

Space Preferences. If ACCESS Integrated has previously requested and received a Space Availability Report for the BellSouth Premises, ACCESS Integrated may submit up to three (3) space preferences on its application by identifying the specific space identification numbers referenced on the Space Availability Report for the space it is requesting. In the event BellSouth cannot accommodate ACCESS Integrated's space preference(s), ACCESS Integrated may accept the space allocated by BellSouth or cancel its application and submit another application requesting additional space preferences for the same BellSouth Premises. This application will be treated as a new application and the appropriate application fee will apply. The application fee will be billed by BellSouth on the date that BellSouth provides ACCESS Integrated with an Application Response.
