Common use of Space Preferences Clause in Contracts

Space Preferences. If TelCove has previously requested and received a Space Availability Report for the Premises, KMC Data may submit up to three (3) space preferences on its application by identifying the specific space identification numbers referenced on the Space Availability Report for the space it is requesting. In the event BellSouth cannot accommodate the TelCove's preference(s), TelCove may accept the space allocated by BellSouth or cancel its application, (without incurring an application fee), and submit another application requesting additional space preferences for the same central office. This application will be treated as a new application and an application fee will be billed by BellSouth on the date that BellSouth provides TelCove with an Application Response.
