SPECIAL CONDITIONS OF THE CONTRACT. (If Any) The intent of the Contract Documents is to include all labor, materials, water, fuel, tools, plants, utility, and transportation services, and all other incidental services and expenses necessary or required for proper execution and completion of the Work. The Contract Documents shall not be construed to create a contractual relationship of any kind (1) between the Architect/Engineer and Contractor; (2) between Owner and a Subcontractor or Sub-subcontractor; or (3) between any persons or entities other than Owner and Contractor.

Such bonds shall be furnished within ten (10) calendar days after the Contractor executes this Agreement. SPECIAL CONDITIONS OF THE CONTRACT. NABARD does not bind itself to accept abnormally low bids. The rates quoted by the tenderer/bidder should be able to demonstrate the capability of the tenderer/bidder to deliver the contract at the offered price. Abnormally low bids/rates will be subject to analysis by NABARD. If required, NABARD may call written clarification from bidder, including detailed price analysis of the bid price in relation to scope, schedule, allocation of risks and responsibilities and any other requirements of the bid document and tenderer/bidder shall have to furnish Rate Analysis for the scrutiny of rates by NABARD within stipulated time. NABARD reserves the right to reject the bid if bid is found to be abnormally low to deliver/perform the contract."
SPECIAL CONDITIONS OF THE CONTRACT. 1. The contract is for a period of 2 years (i.e. 24 months) commencing from 14th day of placing the order / or the actual date of commencement of work whichever is earlier. Subsequently, the contract period may be extended, if required, at the discretion of the Port for a further period with the prevailing rates without prejudice to the conditions of contract.
2. The contractor should have valid GST Number and the contractor should have valid EPF Registration numbers for the Manpower engaged for Operating the RO, STP & WSP Plants.
3. Before the commencement of work, a copy of the “Operation & Maintenance manual” submitted by the OEM (Original Equipment Manufacturer) will be issued for the guidance for operating the plant.
4. The works are to be carried out in a way, not to cause any hindrance /disturbance to the day to day work. The bidder has to take all precautions and measures to ensure safety to the working personnel. The works shall be carried out without any damage to the existing facility / Plant / machinery /structures. Any damaged caused shall be made good by the contractor at his own cost.
5. The contractor has to issue Personal Protective Equipments (PPEs) like Safety shoes, hand gloves, helmet, goggles to the operator. The Contractor should also arrange Uniform, Food, Transportation, Accommodation, etc., for the manpower engaged for operating the RO, STP & WSP Plants which all are included in the Bidder’s Quoted Rate and KPL will be not pay anything extra for the above apart from the quoted rates.
6. The deployed manpower for the RO, STP & WSP Plants should not posses / carry / intake alcohol / drugs / Tobacco during working hours inside the Port Premises. KPL if found any manpower with the above will view seriously and will take necessary action against the contractor.
7. The Contractor shall, at all times, ensure that all its employees are adequately insured and are fully covered for the risks that would be involved while/for carrying out the works and that the insurance policies (detailed below) shall remain in full force and effect until the expiry of the contract. A copy of the following insurance policy shall be taken within 21 days from the date of issue of work order and Policies to be furnished to KPL.

SPECIAL CONDITIONS OF THE CONTRACT. 8.1. The contract on sub tenancy is to be registered in justice institution of state registration of rights of possession of immovable property and bargains with it and is to be sent to the Lessor to the following calculation.
8.2. The term of contract on sub tenancy cannot exceed the term of the Contract.
8.3. At prescheduled cancellation of the Contract the contract on sub tenancy is ceased to be effective.
8.4. The expenses, connected with state registration of the Contract lays on the Leaseholder.
8.5. The contract is worked out in three copies, having equal validity, each Side have one of them, one copy deeds in justice institution of state registration of rights of possession of immovable property and bargains with it, one copy deeds to organ, pointed in 4.2.4.
SPECIAL CONDITIONS OF THE CONTRACT. 6.1 The offices must be available from 1 November 2015 or a date mutually agreed upon between the parties and must meet the Municipality’s specifications fully.
6.2 Although the needs identified in Annexure A are as accurate as possible, they are approximate. Negotiations will be entered into with the Lessor to finalise any changes and preferences in the final lay-out of the offices.
SPECIAL CONDITIONS OF THE CONTRACT. This contract shall remain valid for one year from the date of signing, unless amended by mutual consent.
SPECIAL CONDITIONS OF THE CONTRACT. 1. The Contractor declares that in the performance of the Contract, the Contractor:
a. shall deliver the Subject Matter of the Contract to the appointed delivery locations, i.e. ▇▇-▇▇▇ ▇▇▇▇▇▇ ▇▇. ▇▇▇▇▇▇▇ ▇▇;
b. shall provide instructions for use of Subject Matter of the Contract in Polish;
c. shall carry out the delivery, unloading, placing, installation, commissioning, and training of operators in the operation of the machine;
d. shall bear all costs necessary for the execution of the order resulting from the contents of the order documents and the Contractor's offer attached hereto as Appendix No. 2, as well as those not included therein without which the order cannot be executed.
2. The Contractor declares that:
a. it is entitled to all rights of unrestricted use of the offered Subject Matter of the Contract;
b. the delivered and executed Subject Matter of the Contract will be ready for use and will have the software necessary for such use;
c. The Subject Matter of the Contract is brand new;
d. it shall perform the Subject Matter of the Contract in accordance with the provisions contained in the request for proposal.
3. The Contractor declares that it has the necessary knowledge and experience, as well as the technical capabilities which will enable it to properly perform the Contract.
4. The Contracting Authority shall properly prepare the room in which the Subject Matter of the Contract will be operated.
