Common use of Specific Rights Clause in Contracts

Specific Rights. During the performance of this Agreement, each party hereto shall comply with any and all applicable local, state and federal policies and procedures pertaining to patients’ rights, and shall ensure that its staff and subcontractors take those rights into account when providing services pursuant to the terms and conditions of this Agreement, including, without limitation, the right to: 1. Receive information in accordance with 42 C.F.R. Section 438.10. 2. Be treated with respect and with due consideration for his or her dignity and privacy. 3. Receive information on available treatment options and alternatives, presented in a manner appropriate to his or her condition and ability to understand. 4. Participate in decisions regarding his or her health care, including, without limitation, the right to refuse treatment. 5. Be free from any form of restraint or seclusion used as a means of coercion, discipline, convenience or retaliation. 6. Request and receive a copy of his or her medical records, and to request that they be amended or corrected, as specified in 45 C.F.R. Sections 164.524 and 164.526. 7. Be furnished services in accordance with 42 C.F.R. Sections 438.206 through 438.210.
