Common use of Standard Tenant Services Clause in Contracts

Standard Tenant Services. Landlord shall maintain and operate the Building in a manner consistent with the Comparable Buildings, and shall keep the Building Structure and Building Systems in condition and repair consistent with the Comparable Buildings. In addition, Landlord shall provide, as part of the Building Structure, (i) adequate electrical wiring to subpanel facilities for the Building for Tenant’s connection with a minimum capacity of 3000 Amps at 480 Volts (three (3)-phase, four (4) wire), and (ii) city water and sewer stubbed to the Premises. Notwithstanding the foregoing, Tenant shall pay for all utilities (including without limitation, electricity, gas, sewer and water) attributable to its use of the entire Premises and shall also provide its own janitorial and security services for the Building. Such utility use shall include electricity, water, and gas use for lighting, incidental use and “HVAC,” as that term is defined below. All such utility, janitorial and security payments shall be excluded from Operating Expenses and shall be paid directly by Tenant when due to the utility provider janitorial company and/or security company, as applicable. The Premises is currently separately metered for electricity, water and gas. Landlord shall not be required to provide any services other than with regard to its maintenance and repair obligation relating to the Building Structure and the Common Areas.

In addition to the foregoing, Tenant shall provide, at Tenant’s sole cost and expense, pest control services to the Building in a manner consistent with or greater than the Comparable Buildings. All such utility, janitorial and security payments shall be excluded from Operating Expenses and shall be paid directly by Tenant when prior to the date on which the same are due to the utility provider provider, janitorial company, pest control company and/or security company, as applicable. The parties hereby acknowledge and agree that the Premises is currently separately metered for electricity, water and gasall utilities. Landlord shall not be required to provide any services other than with regard to its maintenance and repair obligation relating to the Building Structure and the Common Areas.

In addition, Landlord shall provide, as part hereby acknowledges that Tenant has upgraded the electrical service supporting portions of the Building StructurePremises and that Tenant shall have the right to use such upgraded electrical service to its full capacity. In addition Tenant may, (i) adequate with Landlord’s prior consent and in accordance with the TCCs of Article 8 of the Lease, below, perform additional upgrades to the electrical wiring to subpanel facilities for the Building for Tenant’s connection with a minimum capacity of 3000 Amps at 480 Volts (three (3)-phase, four (4) wire), and (ii) city water and sewer stubbed to services supporting the Premises. Notwithstanding the foregoing, Tenant shall pay for all utilities (including without limitation, electricity, gas, sewer and water) attributable to its use of the entire Premises and shall also provide its own janitorial and security services for the BuildingBuildings. Such utility use shall include electricity, water, and gas use for lighting, incidental use and “HVAC,” as that term is defined below. All such utility, janitorial and security payments shall be excluded from Operating Expenses and shall be paid directly by Tenant when prior to the date on which the same are due to the utility provider janitorial company and/or security company, as applicable. The Landlord and Tenant hereby acknowledge that each portion of the Premises is currently separately metered for electricity, water and gasor submetered. Landlord shall not be required to provide any services other than with regard to its maintenance and repair obligation relating to the Building Structure and the Common Areas.

The Premises is currently Tenant shall, at Tenant's cost (subject to reimbursement from the Tenant Improvement Allowance pursuant to SECTION 2.2.1 of the Tenant Work Letter), separately metered for electricity, water and gasmeter the Premises. Landlord shall not be required to provide any services other than with regard to its maintenance and repair obligation relating to the Building Structure and Structure, the Project Common Areas, the PCC Common Areas and for Pacific Corporate Center (subject to the TCCs of SECTION 4.3 above).
