Stop Payment. You may initiate stop payment requests online via the Online Banking System only for paper checks you have written (non-electronic) on your Bank accounts. The System allows you to:
(1) place a stop payment order request of up to six (6) months in duration; or (2) determine the paid status of a check. If you use the Services stop payment feature, then you must follow the procedures and specification described in this Agreement. The cut-off time for us to receive a stop-payment request is 5:00 PM on a business day and a stop payment request received after that time or on a non-business day will be processed on the next business day. You must provide the Bank with complete and accurate information in a timely manner on: the account number, the date of the item or check; the item or check number; the EXACT amount of the item or check (dollars and cents); the payee name and the reason for the stop payment. If any information is incomplete or incorrect, the Bank will not be responsible for failing to stop payment on the item or check. The Bank shall have no responsibility to determine the accuracy of such information. Stop payment requests which cover a range of checks or items that are missing or stolen will be processed without regard to the dollar amount. The Bank is not responsible for stop payment requests received for items or checks that have already cleared or been paid from your account. The Bank may provide you notice of the actual stop payment of items drawn on a check by making such information accessible to you online via the System. Stop payment orders are effective for only six months unless renewed by you prior to expiration of the original order. From time to time, the Stop Payment Service may be inoperable. Stop Payment. You may initiate stop payment of items drawn requests online via the System only for paper checks you have written (non-electronic) on your Bank accounts. If you use the Services stop payment feature, then you must follow the procedures and specification described in this Agreement. The cut-off time for us to receive a stop-payment request is 5:00 pm on a business day. A stop payment request received after that time or on a non-business day will be processed on the next business day. You must provide the Bank with complete and accurate information in a timely manner which includes the following; Account number, Date of the item or check; Item or check number; Exact amount of the item or check (dollars and cents); Payee name and; Reason for the stop payment. If any information is incomplete or incorrect, the Bank will not be responsible for failing to stop payment on the item or check. The Bank shall have no responsibility to determine the accuracy of such information. The Bank is not responsible for stop payment requests received for items or checks that have already cleared or been paid from your account. Stop payment orders are effective for only six (6) months unless renewed by you prior to expiration of the original order. From time to time, Services may be inoperable. If that occurs, your request can be communicated to the Bank by telephone instructions. For purposes of this Agreement, if we have used ordinary care and followed our usual practices in handling a "reasonable time" means (i) for all stop payment orders entered before the relevant Stop Payment Cut-off Time, not later than 9:00 p.m. on such an day, or (ii) for all stop payment orders entered after the relevant Stop Payment Cut-off Time, not later than 9:00 p.m. on the next banking day following entry of the order. To prevent unjust enrichment and only to the extent necessary to prevent loss to us by reason of its payment of the item, you agree we are subrogated to the rights (1) of any holder in due course on the item against the drawer or maker; (2) of the payee or any other holder of the item against the drawer or maker either on the item or under the transaction out of which the item arose; and (3) of the drawer or maker against the payee or any other holder of the item with respect to the transaction out of which the item arose. In that regard, you should be aware that a stop order does not relieve you of your obligation on a check that has been negotiated to a holder in due course. If we re-credit your account after paying an item a check over a valid and timely stop payment order, you agree to take whatever action we deem necessary to transfer to us all of your rights against the payee or other holder of the item check, and to assist us if we take in any legal action taken against that person later on. Any person who is authorized to draw checks against the payee account may give a release or any other personcancellation of a stop payment order. In Stop payment orders on official checks, cashier's checks, or money orders are not permitted. If an official check, cashier's check, or similar item has been lost, stolen or destroyed, you may provide a declaration of loss and affidavit and request the event check be re-issued. The bank may require that you instruct us to stop payment of certain pre-authorized debitswait ninety (90) days (or provide a bond where permitted by law) before honoring your claim, you acknowledge and agree that, at our option, we may stop payment of all pre-authorized debits from your account if we deem that action necessary to ensure that your stop payment order will be effective. You also acknowledge and agree that we will not be liable to you if such check is cashed prior to expiration of the ninety (90) days (or receipt of bond, if applicable). Stop payment orders (both oral and written) are valid for our failure to six (6) months unless you designate a longer period of time when placing the stop payment order. You may extend a stop payment order by calling or writing us prior to the expiration of the existing stop payment order. Stop Payment. You The System may allow you to request stop payment on Customer Checks. However, the Bank’s acceptance of items drawn a stop payment order will not constitute a representation that the Customer Check has not already been paid, or that the Bank has areasonable opportunity to act upon the stop payment order. Stop payment on your accountsa ▇▇▇▇ Payment transaction must be placed through the ▇▇▇▇ Payment Service. Prior to requesting a stop payment, you should first verify that the Customer Check has not already been posted toyour Account.
