Common use of Storage Conditions Clause in Contracts

Storage Conditions. ICS will maintain Product stored at, and shipped from, its facilities under (i) the Product storage, shipment and handling requirements set forth in the Statement of Work included in Exhibit B, (ii) any applicable SOPs and (iii) any other conditions required by the FDA approved labeling. ICS shall notify Dyax within one (1) business day of any known deviation from such requirements so that Dyax can determine whether any further action must be taken with respect to such Product. Failure of ICS to notify Dyax promptly of such known deviation shall constitute a breach of this Agreement by ICS.
