STREAMSIDE MANAGEMENT ZONES Clause Samples

The Streamside Management Zones clause establishes specific areas adjacent to streams or water bodies where particular management practices or restrictions apply to protect water quality and riparian ecosystems. Typically, this clause outlines buffer zones where activities such as logging, construction, or pesticide application are limited or require special procedures to minimize soil erosion and prevent contamination of waterways. Its core function is to safeguard sensitive aquatic environments by regulating land use near streams, thereby reducing environmental impact and ensuring compliance with environmental protection standards.

STREAMSIDE MANAGEMENT ZONES. (11/98) A Streamside Management Zone (SMZ) is a zone that contains riparian vegetation or other special characteristics. Areas identified as Streamside Management Zones (SMZ's) are areas marked on the ground or are within the distances identified on the Sale Area Map measured from the centerline of stream courses. Centerlines will be designated in N/A flagging in the field, by the Forest Service prior to release of payment unit. Timber designation, conduct of logging, and/or slash treatment may differ in the SMZ from the rest of the unit. Unless otherwise agreed to in writing and notwithstanding the contract requirements otherwise applicable to each payment unit, the following special requirements apply to the SMZ of the payment units specified below: Payment Unit(s) Zone Requirements ALL -Tree ▇▇▇▇▇ must be cut and laid with butts perpendicular to the stream course. -Equipment may enter and exit the streamside management zone perpendicular to the stream course only. -All merchantable material must be removed from streamside management zone. -Buffers range from 50-150’ – See Sale area map Sale Name: ▇▇▇▇▇▇ Draft 07/14/2020 Contract 2400-6T, (6/06) CT6.6 - EROSION PREVENTION AND CONTROL (08/1992) Unless waived in writing, erosion prevention and control work, required by BT6.6 shall be completed within 15 calendar days after skidding operations related to each landing are completed or after Forest Service designation on the ground of work where such designation is required hereunder. Said time limit shall be exclusive of full days lost in Purchaser's Operations due to causes beyond Purchaser's control. Damage resulting from Purchaser's operations, due to failure to perform required work, shall be repaired by Purchaser. When not adequately protected from erosion by treatments such as out-sloping and cross draining or grass seeding, place lopped slash and logging debris in temporary roads, landings and skid trails. CT6.601# - EROSION CONTROL SEEDING (02/1987) Following completion of skidding and yarding operations in an area, Purchaser shall seed areas of exposed soil on skid trails, landings, firebreaks, and Temporary Roads where other erosion control measures described in BT6.6 will not result in satisfactory control of soil movement. Seed bed preparation shall consist of surface scarification on roads and landings sufficient for retention of seed. Seed shall be broadcast evenly at the rate of 10 pounds of seed per acre. STREAMSIDE MANAGEMENT ZONES. Grantor shall protect the streams and watercourses on the Property by establishing the following Streamside Management Zones (“SMZs”) A. Streams identified on the schedule attached to this Exhibit D shall be subject to the SMZ guidelines described below. Treatment of additional streams not identified shall be agreed to by Grantor and Grantee in the Forest Stewardship Plan. B. Grantor shall manage the SMZs for mature natural forests. No Forest Management activities (except road crossings) are allowed within fifty (50) feet of each side of the stream channel edge (“Zone 1”), unless the activity is intended to promote the ecological health of the SMZs, as determined by the Grantee. Forest Management and timber harvesting may occur within the area fifty (50) to one-hundred- fifty (150) feet from each side of the stream channel edge (“Zone 2”), provided it is intended to promote a mature natural forest and the remaining stand has a basal area greater than seventy (70) square feet of living trees per acre. No herbicide or fertilizer may be applied in the SMZs, unless Grantee determines it is necessary to promote the ecological health of the SMZs. C. Grantor and Grantee recognize that areas in Zone 1 or Zone 2 may as of the date of the Page two of three Conservation Easement consist of loblolly pine plantation. In those situations, Grantor shall encourage the transition to a more natural mixed forest through selective harvests that thin the pine plantation and encourage development of hardwood trees. D. Grantor and Grantee recognize that some of or portions of the SMZs may be intensively managed as Public Drainage Association ditches, and acknowledge that the Conservation Easement and this STA Plan are subordinate to public drainage easements. E. Where a dirt roadway exists within a SMZ, Grantor shall limit its use of that road to those activities necessary for Forest Management and shall attempt to keep the road vegetated with grasses whenever possible.
