Common use of Subsequent Acquisitions upon Exercise of Stock Options Clause in Contracts

Subsequent Acquisitions upon Exercise of Stock Options. Upon the acquisition by the Employee of Common Stock following the date of this Agreement upon the exercise of additional stock options held by the Employee, the shares of Common Stock acquired upon such exercise shall be deemed to be “Shares” for purposes of the substantive provisions of this Agreement (and, in addition, shall be deemed to be “Converted Holdings Option Shares” if acquired upon exercise of a Converted Holdings Option). In such event an appropriate notation shall be made by the Company to the signature page hereof to reflect such increased number.
