Common use of Subservicing Arrangements Clause in Contracts

Subservicing Arrangements. The Servicer may enter into subservicing agreements for the servicing and administration of all or a part of Serviced Assets, provided that, in each case, the subservicing agreement: (a) is consistent with this Agreement in all material respects and requires the subservicer to comply with all of the applicable conditions of this Agreement. References in this Agreement to actions taken or to be taken by the Servicer include actions taken or to be taken by a subservicer on behalf of the Servicer.

The Servicer may enter into subservicing agreements for the servicing and administration of all or a part of Serviced Assets, Mortgage Loans and/or the Receivables; provided that, in each case, the subservicing agreement: (a) agreement is consistent with this Agreement in all material respects and requires the subservicer to comply with all of the applicable conditions of this Agreement. References in this Agreement to actions taken or to be taken by the Servicer include actions taken or to be taken by a subservicer on behalf of the Servicer.
