Substantial Completion Subsequent to Scheduled Substantial Completion Date; Delay Liquidated Damages. In the event that Substantial Completion occurs subsequent to the scheduled Substantial Completion Date, the Company shall be liable for and shall pay to the Village, or cause the Company’s surety to pay the Village, daily delay liquidated damages as herein stipulated for each and every calendar day that the Company shall have failed to achieve Substantial Completion after the scheduled Substantial Completion Date.

The amount of daily delay liquidated damages payable by the Company and herein stipulated pursuant to this Section shall be $ 5,000.00 for each and every calendar day of delay in achieving the Substantial Completion Date. Such damages shall be payable by the Company, or the Company’s surety, to the Village as a direct reduction to the Design/Build Price or within ten (10) days of written notice by the Village and, upon any termination for failure to achieve Substantial Completion, upon the date of termination

  • Substantial Completion Date Substantial Completion of the Work as defined in Article 6.1.2 of the General Conditions to the Continuing Contract for Construction Management shall be achieved by July 31, 2022.
