Substitute or Additional Service Aircraft or Component. ‌ 3.1 Contract Price for Substitute Aircraft or components‌ a. Where the Contractor substitutes any component of the Service, such as the Aircraft, if the substitute component has a capacity or performance that exceeds that of the replaced component, the Contract Price payable in relation to the Service must not increase. b. Where the Contractor substitutes any component of the Service, such as the Aircraft, if the substitute component has a capacity or performance that is less than that of the replaced component, the Contract Price payable in relation to the Service must be negotiated with NAFC and must reflect the reduced capacity or performance of the component. 3.2 Contract Price for additional Services‌ a. Additional Services will be provided by the Contractor to NAFC at the rates for the equivalent contracted Service as detailed in this Schedule. Excess mobilisation/demobilisation costs for additional Services, if applicable, may be reimbursed to the Contractor at cost, provided that NAFC has agreed to those costs prior to the engagement of the additional Services. b. Where the Contractor provides additional Services that have a capacity or performance that exceeds the equivalent contracted Service, the Contract Price payable in relation to the additional Services must not increase. c. Where the Contractor provides additional Services that have a capacity or performance that is less than the equivalent contracted Service, the Contract Price payable in relation to the additional Services must be negotiated with NAFC to reflect the reduced capacity or performance of the Service.

  • Condition of Aircraft The Aircraft at the time of its return to Lessor shall have been maintained in accordance with the provisions of this Agreement with the same care and consideration for the technical condition of the Aircraft as if it were to have been kept in continued regular service by the Lessee, and shall meet the following requirements:

  • Approved Services; Additional Services Registry Operator shall be entitled to provide the Registry Services described in clauses (a) and (b) of the first paragraph of Section 2.1 in the Specification 6 attached hereto (“Specification 6”) and such other Registry Services set forth on Exhibit A (collectively, the “Approved Services”). If Registry Operator desires to provide any Registry Service that is not an Approved Service or is a material modification to an Approved Service (each, an “Additional Service”), Registry Operator shall submit a request for approval of such Additional Service pursuant to the Registry Services Evaluation Policy at ▇▇▇▇://▇▇▇.▇▇▇▇▇.▇▇▇/en/registries/rsep/rsep.html, as such policy may be amended from time to time in accordance with the bylaws of ICANN (as amended from time to time, the “ICANN Bylaws”) applicable to Consensus Policies (the “RSEP”). Registry Operator may offer Additional Services only with the written approval of ICANN, and, upon any such approval, such Additional Services shall be deemed Registry Services under this Agreement. In its reasonable discretion, ICANN may require an amendment to this Agreement reflecting the provision of any Additional Service which is approved pursuant to the RSEP, which amendment shall be in a form reasonably acceptable to the parties.

  • Substitution of Equipment In the event the Computer is inoperable, ASL has a limited number of spare laptops for use while the Computer is being repaired or replaced. This agreement remains in effect for such a substitute. The Student may NOT opt to keep a broken Computer or to avoid using the Computer due to loss or damage.

  • REPAIRED OR REPLACED PARTS / COMPONENTS Where the Contractor is required to repair, replace or substitute Product or parts or components of the Product under the Contract, the repaired, replaced or substituted Products shall be subject to all terms and conditions for new parts and components set forth in the Contract including Warranties, as set forth in the Additional Warranties Clause herein. Replaced or repaired Product or parts and components of such Product shall be new and shall, if available, be replaced by the original manufacturer’s component or part. Remanufactured parts or components meeting new Product standards may be permitted by the Commissioner or Authorized User. Before installation, all proposed substitutes for the original manufacturer’s installed parts or components must be approved by the Authorized User. The part or component shall be equal to or of better quality than the original part or component being replaced.

  • Specified Equipment 4.2.1 Subject to paragraph 4.2.3, the Train Operator has, in relation to a Service, a Firm Right to use any equipment registered with RSSB’s R2 system which has performance characteristics identical to or better than the Timing Load specified in the Rights Table for such Service. 4.2.2 Subject to paragraph 4.2.3, the Train Operator has, in relation to a Service, a Contingent Right to use any equipment registered with RSSB’s R2 system. 4.2.3 No rolling stock may be used unless and until it has achieved vehicle and route acceptance necessary for its use on the Network.
