Common use of Summary Dismissal Clause in Contracts

Summary Dismissal. Notwithstanding the provisions of 13.1.1 hereof, the Employer shall have the right to dismiss any Employee without notice for conduct that justifies instant dismissal, including malingering, inefficiency or neglect of duty and in such cases the wades shall be paid up to the time of dismissal only.

Notwithstanding the provisions of 13.1.1 hereofclause 2.9.1 herein, the Employer an employer shall have the right to summarily dismiss any Employee employee without notice for conduct that misconduct which justifies instant dismissal, including malingering, inefficiency or neglect of duty and in such cases case the wades wages shall be paid up to the time of dismissal only.

Notwithstanding the provisions provision of 13.1.1 hereof, hereof the Employer employer shall have the right to dismiss any Employee employee without notice for conduct that justifies instant dismissal, including malingering, inefficiency or summary dismissal as provided by the Workplace Relations Act 1996 which is not limited to but includes neglect of duty duty, assault upon a client, visitor or fellow employee, proven instances of theft and in acts of wilful disobedience of a lawful and reasonable instruction from the employer (or delegate). In such cases the wades wage shall be paid up to the time of dismissal only.

Notwithstanding the provisions of 13.1.1 14.1(a) hereof, the Employer shall will have the right to dismiss any Employee employee without notice for conduct that justifies instant dismissal, including but not limited to malingering, inefficiency inefficiency, neglect or neglect refusal of duty or misconduct and in such cases wages due to the wades shall employee will be paid up to the time of dismissal only.
